<br />0021;)4 <br /> <br />Contractor should consider consolidating or breaking out procurements to obtain more <br />economical purchases. Where appropriate, the Contractor shall compare leasing and purchasing <br />alternatives to determine which is more economical. The Contractor shall also perform a cost or <br />price analysis in connection with every procurement action, including subcontract modifications, <br />and shall use the results of this analysis to substantiate the reasonableness of the price. <br /> <br />4. Procurement ofBatched Products. As noted in Part I of this Contract, Public Law <br />100-545, as amended, allows for the construction functions of the Animas-La Plata Project to be <br />contracted to the Colorado Ute Tribes under P.L. 93-638. <br /> <br />By resolutions dated November 7, 2001 and August 31, 2001 the Ute Mountain Ute and Southern <br />Ute Tribes agreed on how to divide the various Animas-La Plata Project components among the <br />Tribes and the United States. The two Tribes since that time have agreed that the original <br />division of work shall be amended to reflect that the Southern Ute Indian Tribe shall be the sole <br />producer and supplier of all batched products for the Animas-La Plata Project. <br /> <br />Therefore, in accordance with the divisibility of work, the Contractor agrees to utilize Sky Ute <br />Sand and Gravel, a wholly-owned enterprise of the Southern Ute Tribe, for batched products <br />such as: <br /> <br />I. Concrete <br />2. Shotcrete aggregates <br />3. Ready Mix grout for grouted rip-rap <br />4. Soil cement slurry <br />5. Gravel surfacing <br />6. Asphalt concrete <br />7. Roller compacted concrete aggregates <br /> <br />The Contractor and his supplier shall perform their work in such a manner to meet all <br />specifications requirements and shall be strictly responsible for all business operations and <br />associated coordination. In the event there is a performance issue between Sky Ute Sand and <br />Gravel and the Contractor the parties shall work between themselves to Iesolve the issue. If <br />resolution can not be reached and at the request of both parties, the Contracting Officer may help <br />to resolve the issue. <br /> <br />5. Indian Preference. As required by applicable law, the Contractor and its <br />subcontractors shall provide preference to qualified Indians and Indian Organizations and the <br />Contractor shall establish appropriate procurement policies to implement such preference. <br /> <br />6. Competition. The Contractor shall conduct all major procurement transactions by <br />providing full and open competition, to the extent necessary to- assure efficient expenditure of <br />Contract funds and to the extent feasible in the local area. <br /> <br />20 <br />
