The objective is to have the contract in II provide the <br />quantification. <br /> <br />IV. TNC Donation <br /> <br />D. <br /> <br />A. <br /> <br />The Colorado Water Conservation Board accepted the donation of a 300 cfs <br />conditional water right from The Nature Conservancy at its January 22,1992 <br />meeting. The water right when changed will protect flows from just below <br />the Gunnison Tunnel to the North Fork confluence. <br /> <br />B. <br /> <br />A water right change application (92CWI07) was prepared and filed in Division <br />4 Water Court on August 11, 1992. Nine statements of opposition were filed. The <br />Division Engineers consultation with the Referee found the change as applied for <br />presented problems from the standpoint of water right administration. We have <br />discussed the issues with the Division Engineer and are in the process of <br />developing solutions. <br /> <br />C. <br /> <br />Passage of State Senate Bill 94-54 limiting the Board's ability to accept <br /> <br />conditional water rights resulted in all serious opposition, except for that by <br /> <br />Arapahoe County, being withdrawn. Judge Brown held hearings on the States <br /> <br />56(h) motions and ruled favorably on those on October 11, 1994, except he found <br /> <br />the earliest appropriation date possible was July 1,1973. Endangered Species Act <br /> <br />A. Section 7 consultation on CRSP/Aspinall Unit IS ongomg and scheduled for <br />completion in September, 1997. <br /> <br />B. Colorado River Endangered Fish Recovery Program <br /> <br />1. Redlands Dam fish passage is a relatively high priority in the RIPRAP. <br />Design options have been evaluated by the Bureau of Reclamation and US <br />Fish and Wildlife Service. The Redlands Water and Power Company is <br />willing to work with the Recovery Implementation Program. Preliminary <br />design for a passage structure going around the left abutment has been <br />completed. It is estimated that 100 cfs will be required to operate the <br />ladder and provide attraction flows. The Service has estimated that between <br /> <br />3 <br /> <br />0008~O <br />
