FEB-07-1997 11:07

DEPT OF NATURAL RESOURCES

1 303 866 4058 P.04/14

.002171

decrees based on the priority of the decrees aud will issue the
appropriate orders to the entities invoJved_ Transmountain
decrees may continue to divert when they are out of p~iorjl,
only if they provide replacement water to Lhe River. The CBT
Project may replace its transmountaln diversions using the
52,000 AF Green Mountain decree described previously.

Under STBP 3 we will need to have each Water Commissioner
provide us with a report hy Tuesday of each weck listing lhe
namea of all tbe active diversions in your District (not shut
off in previous Steps) ahove lbe Grand Valley Canal which hre
junior to the 119.47 decree which are nat being replaced Or
augmented and qualify to be replaced from Green Mountain
storage. In addition to the name of each diversion, we would
like to have the amount of diversion recorded at your last
inspection and the date of that observation. The office staff
will then take this infor~ation Bnd allocate the Green Mounlaln
consumptive use replacements to the proper decrees. This
information will also be used to determine when replacement
reservoir releases must end.

STEP 4: As the River continues to drop we will reach the point
;iier;;-we will be replacing consumptive use for ..II tha decr'ces
reported by you which are junior to the 119.47 cfs decree and
there still will not be sufficient water to satisfy the
decree. In the event that this does occur, we will continue to
release Green Mountain Reservoir water to salisfy the decree
and will attribute the release to the 119.47 cfs decree itself
and not to the consumptive use of a junior decree. This flow
release of 119.74 crs will continue as long as water is needed
and is available in the 66,000 AF pool.

QQ!!~1!12lL~: Grand Valley Water Users Association places a call
on tbe Colorado River using its 1941 decree of
400 cfs for power generation (ADMIN NO 30895.21241).

As soon as the 1941 decree for 400 crs begins to run short, lhe
office staff will order releases out of Green Mountain
Reservoir sufficient to meet the de~and. These releases will
be in addition to the 120 cfs release being made under
CONDITION I, STEP 4. The release will be delivered to satisfy
the 400 cfs decree but we are actually replacing the
consumptive use of irrigation aad domestic decrees that would
have been called out by the 1941 decree if Green Mountain water
was not available. This allows those junior ditches to
Continue diverting even though they are out of priority.

- 3 -.
