The United <br />States Section, pursuant to Article 13 of the <br />1944 Mexican Water Treaty, should seek to have <br />the united States and Mexico cooperatively <br />provide for any needed improvements and the long <br />term maintenance of the Floodway in this common <br />reach of the river. <br /> <br />Bureau of Indian Affairs, Department of the Interior <br /> <br />(A) In consultation with the affected tribes, review <br />all studies and recommendations developed <br />pursuant to the Colorado River Floodway <br />Protection Act to ensure that the trust <br />responsbilities of the united States are met. <br /> <br />(B) Provide technical guidance and review to the <br />tribes regarding studies to be carried out <br />relative to provisions of the Act. <br /> <br />(C) In consultation with the affected tribes, execute <br />its trust responsibilities by implementing all <br />mitigation measures required to carry out the <br />intent of this report pursuant to Section 15 of <br />the Act, including seeking adequate appropria- <br />tions. <br /> <br />VI. ISSUES <br /> <br />Determinations as to whether leases and uses of federal <br />lands adjacent to the river are consistent with the operation <br />and maintenance of the Floodway. <br /> <br />DISCUSSION <br /> <br />More than two-thirds of the lands adjacent to the lower <br />Colorado River area are owned or controlled by the United <br />States, with the Bureau of Land Management administering most <br />of the federal lands. Section 13 of the Floodway Act <br />provides that leases of lands within the Floodway owned in <br />whole or in part by the united States are required to be <br />consistent with the operation and maintenance of the <br />Floodway, with the Secretary of the Interior being <br />responsible for making such determinations. With respect to <br />such existing leases, the Act provides that no lease shall be <br />extended beyond the stated current expiration date, unless <br /> <br />III-14 <br />
