<br />. <br /> <br />. <br /> <br />. <br /> <br />002223 <br /> <br />the lessee ag rees to ta ke re asonable and pr uden t steps <br />determined to be necessary by the Secretary to minimize the <br />inconsistency of operation under such lease with the <br />operation and maintenance of the Colorado River Floodway. <br />Pursuant to Section 13(e) of the Act, these provisions do not <br />apply to Indian lands with "respect to any lease where <br />capital improvements, and operation and maintenance costs are <br />not provided for by federal financial assistance if the <br />lessee, tribe, or individual has provided insurance or other <br />security for the benefit of the Secretary sufficient to <br />insure against all reasonably foreseeable, direct, and conse- <br />quential damages to the property of the tribe, private <br />persons, and the United States, which may result from the <br />proposed lease." <br /> <br />The Act also provides, in Section 13(c), that no lease <br />of lands owned in whole or part by the United States between <br />Hoover Dam and Davis Dam below elevation 655.0 feet above sea <br />level on Lake Mohave shall be granted unless the Secretary <br />determines that such lease would be consistent with the <br />operation of Lake Mohave. <br /> <br />RECOMMENDATIONS <br /> <br />It is recommended that the Secretary's responsibilities <br />for determinations as to whether leases and uses of federal <br />lands adjacent to the river, including river bank treatments <br />and improvements, are consistent with the operation and <br />maintenance of the Floodway, be centralized and that those <br />responsibilities be appropriately delegated to the Bureau of <br />Land Management for non-Indian lands and to the Bureau of <br />Indian Affairs for Indian lands, with technical assistance to <br />be provided by the Bureau of Reclamation. <br /> <br />VII. ISSUE <br /> <br />River operations, consistent with "The Law of the <br />River," that provide for more effective river management for <br />both flood control and protec tion of re se r voi r stor age <br />capac i ty . <br /> <br />DISCUSSION <br /> <br />Pursuant to the Criteria for Coordinated Long-Range <br />Operation of Colorado River Reservoirs (Operating Criteria), <br />the Secretary of the Interior, in consultation with the Basin <br />states, develops an annual plan of operation for the Colorado <br />Ri ver reservoir system which is transmi tted, along with any <br />subsequent revisions to the plan, to the Congress and to the <br />Governors of the Basin states.
