Ute Mountain Ute Reservation - 350 acre-feet <br />per year in the McElmo Creek drainage and 1.500 acre-feet per <br />year in the remainder of the reservation. <br /> <br />11. Southern Ute Reservation - 2.000 acre-feet per <br />year. with certain limitations on wells in the La Plata River <br />drainage. <br /> <br />V. Administration of Tribal Winters Reserved Riqht Waters <br /> <br />1. Introduction. The State and Tribes acknowledge the <br />hydrologic relationships between the waters allocated to the <br />parties and the waters needed to meet the requirements of <br />interstate compacts. <br /> <br />2. Surface Diversions. The State Engineer will have <br />administrative responsibility over all waters apportioned to <br />the Tribes at the main diversion points from the river. The <br />Tribes will administer the water on their reservations. The <br />Tribes agree to install measuring devices and allow inspections <br />by the State Engineer. to furnish information about lands <br />irrigated. and to allow the State Engineer to monitor their <br />diversions in case a compact call is put on the river. <br /> <br />3. Dams and Reservoirs. <br />maintain dams and reservoirs <br />them to insure pUblic health <br /> <br />The Tribes agree to properly <br />and to allow the State to inspect <br />and safety. <br /> <br />4. Individual and Domestic Livestock Wells. Information <br />will be provided to the State Engineer by the Tribes. <br /> <br />5. Aquifer Protection. The Tribes agree to drill. <br />maintain. or abandon wells in a manner consistent with the <br />pUblic health and safety and to file the customary reports with <br />the State Engineer. <br /> <br />6. Chanqe of Use. The Tribes may be granted a change of <br />use of water if the change does not increase the Tribe's <br />consumptive use or injure other water users. as described in <br />the Agreement. <br /> <br />7. State Adiudicated Water Riqhts. This administrative <br />agreement governs the Winters reserved water rights of the <br />Tribes. but all other waters appropriated by the Tribes under <br />state laws will be governed by state law. <br /> <br />VI.
