The below described Winters rights <br />are based upon an irrigation season from May 1 to September 30 <br />and will be used at agreed upon locations as set forth in the <br />Agreement: <br /> <br />i. Florida River - The Tribe will use water stored <br />behind Lemon Dam in exchange for Winters water rights for <br />certain lands. In this regard. the Florida Water Conservancy <br />District will allocate 553 acre-feet per year to the Tribe from <br />the project and the Tribe will pay for O&M charges. Annual <br />volumes of water. diversion rates. and net acreages for all <br />other lands upon which agreement was reached are set forth in <br />Table 1 of the Agreement. The annual volume of water to be <br />received by the Tribe for these other lands is 1.090 acre-feet. <br /> <br />ii. Stollsteimer Creek - The Tribe shall receive an <br />1868 storage right for Lake Capote for 1.850 acre-feet with no <br />refill. and a 1986 right for one refill. An existing right for <br />530 acre-feet will be forfeited. The Carruthers Ditch right <br />for 2 cfs shall be removed from the abandonment list and <br />subordinated to all direct flow rights adjudicated before <br />1986. The Tribe will retain its 3.5 cfs direct flow right with <br />a priority of 1914 in Washington Flats Ditch. An augmentation <br />plan developed by Fairfield-Pagosa is recognized. <br /> <br />iii. Piedra River - Net acreages. diversion rates. <br />and annual volumes of water (totaling 1.595 acre-feet) were <br />agreed to as set forth in Table 2 in the Agreement. <br /> <br />iv. Devil Creek - The Tribe will receive an 1868 <br />priority date for 1 cfs. with a maximum diversion of 183 <br />acre-feet per year. subordinated to all rights adjudicated <br />before 1976. <br /> <br />v. San Juan River - Net acreages. diversion rates. <br />and annual volumes of water (totaling 1.530 acre-feet per year) <br />were agreed to as set forth in Table 3 in the Agreement. <br /> <br />vi. Round Meadow Creek - The Tribe will be given an <br />1868 priority date for a maximum total volume of 975 acre-feet <br />per year. <br /> <br />vii. Cat Creek - The Tribe will be given an 1868 <br />priority date for a maximum total diversion of 1.371 acre-feet <br />per year. <br /> <br />3. Further Quantification <br /> <br />a. Existinq Uses. Any existing use of surface or <br />ground water for which the Tribes desire a Winters right shall <br />be identified as to all specifics by July 1. 1986. If <br />agreement is reached on them they shall be recognized as <br />additions to the Winters water rights awarded to the Tribes. <br /> <br />-4- <br />
