Construction and <br />operation and maintenance (O&M) costs for water used for fish <br />and wildlife development will be nonreimbursable under section <br />8 of the Colorado River Storage Project (CRSP) Act. <br /> <br />b. Animas-La Plata Prolect. An average annual <br />supply of 26.400 acre-feet of agricultural irrigation water and <br />6,000 acre-feet of M&I water delivered at Ridges Basin <br />Reservoir. After completion of the Tribe's irrigation <br />facilities. the irrigation water will be delivered either at <br />Ridges Basin Reservoir or at the Tribe's facilities, as desired <br />by the Tribe. M&I water allocations will be fully satisfied. <br />Agricultural irrigation water will share shortages with other <br />Colorado users. Construction costs allocable to irrigation <br />will be deferred under the Leavitt Act and O&M costs shall be <br />made nonreimbursable under special legislation. Costs <br />allocable to M&I water shall be deferred, and interest shall <br />not accrue during the deferral period. pursuant to special <br />legislation until revenues can be generated from the M&I water. <br /> <br />c. Other Sources. <br /> <br />i. Mancos River - 21.000 acre-feet per year for <br />irrigation of 7.200 acres of land with an 1868 priority date <br />subordinated to all rights with an adjudication date prior to <br />1985. <br /> <br />ii. Navalo Wash - A direct flow reserved water <br />right for diversion of 4.800 acre-feet per year for 1,200 acres <br />of land with an 1868 priority date subordinated to all rights <br />with an adjudication date prior to 1985. <br /> <br />iii. <br />right for 10 cfs <br />annual diversion <br /> <br />San Juan River - A <br />with priority date <br />of 1,600 acre-feet <br /> <br />direct flow reserved water <br />of 1868, with a maximum <br />for irrigation of 640 acres. <br /> <br />2. The Southern Ute Indian Tribe shall be entitled to <br />the rights to use water from the following sources: <br /> <br />a. Animas-La Plata Prolect. An average annual <br />supply of 26.500 acre-feet per year of M&I water and 3.400 <br />acre-feet per year of agricultural irrigation water from Ridges <br />Basin Reservoir pending completion of Southern Ute Reservoir. <br />M&I water allocations shall be fully satisfied. Agricultural <br />irrigation water shortages will be shared pro rata with other <br />Colorado users. Construction costs allocable to agricultural <br />irrigation water shall be deferred pursuant to the Leavitt <br />Act. Costs allocable to the Tribe's M&I water shall be <br />deferred, and interest shall not accrue during such deferral. <br />pursuant to special legislation until M&I water revenues are <br />available. <br /> <br />-3- <br />
