<br />001201 <br /> <br />Abandoned Water Riqhts <br /> <br />. Approximately 40 appropriative water rights are <br />on Water Division ones abandonment list. Park staff are <br />preparing evidence of historic use and quantities to prevent <br />these rights from being declared abandoned. Confirmation is <br />forthcoming from Mr. Czarnoski that these 40 are on of the <br />same already addressed. See item 6, page 2 of attached Bill <br />McDonald memorandum dated September 22, 1987. <br /> <br />Relevant to the parks stand on water rights <br />issues the document notes on page 20 the Colorado State <br />Legislature Act of February 9, 1929 (Sessions Laws of <br />Colorado, Pg. 475) which cedes exclusive jurisdiction over <br />Rocky Mountain National Park to the USA. The Congressional <br />Act of March 2, 1929 (45 Statute.1536) accepted the cessation <br />of jurisdiction reserved for the state except for: <br /> <br />. . . . and saving to the people of Colorado all <br />vested, appropriated, and existing water rights and rights-of- <br />way connected therewith, including all existing domestic or <br />irrigation conduits and ditches.... <br /> <br />RECOMMENDATION <br /> <br />Await Mr. Czarnoski's response and add it to this <br />memorandum.
