The Pathfinder Irrigation Distridt is re-locating the laterals
to be lined by the C. C, C. forces vmerever a better location can be h~d.
And in the perfor~.nces of this it is necessary to change the point at '
which the laterals pass under the ChicaGO Burlington and Quincy R.ilroad.
In each one of these changes the Railroad Comp~ny requires the Pathfinder
Irrigation District to enter into a contrv,at to Ilk'lintain, ~t least, a
portion of the structure. It was necessary to build a syphon under the
tracks to nccomodate 0. br:o.nch of laternl #24, :>.nd the e)ntN.<lt with the
Railroad Company vm.s submitted to the BO'1rd, and the following rcsolution
was finally adopted.

WHEREAS; The members of the C. C. Camp havo re-loc~.ted !.Cnd concrete
lined a branch of Lc.teral #24, and

~~S; The Bro.nch of this lateral will cross the Railroad :.t a
point in Section 19, Township 23 N., Range 54 W, which is a different
location than that of the original lateral, and

;iHEREAS: An agreement has been submitted to the Pdhfinder Irrig~:,tion
District under the terms of which the Chicago, Burlington, and Quincy Rail-
road will furnish the materili1., and c.:>nstruct a pipe line 32 feet long and
of a 36 inch diar.leter to pass the ~c.ter under the Railroad at its ~wn cost
and expense.

WHEREAS: The Pathfinder Irrig-,tion District will cause to be con-
structed the head walls, and out-let nnd in-let on the pipe to form a
syphon. This shall be done'without expense to the Chicago~ Burlington
and ~incy Railroad Company.

Therefore, Be It Resolved: That the Board of Directors of the
Pathfinder Irrigation Distri~ hereby authorize the prcsident and secret~ry'
of the Pathfinder Irrigation District to sign an agreement with the Chicago,
Burlington and Quincy Railrond Comp"ny to fulfil the terms of the o.greenent
mentioned in this resolution.

An organization of the Boards of the Directors .:>f the severnl
Irrigation Districts in the Vallc7 was formed to prevent the shutting off
of lmters in the vnlley by the State Dep:',rtment of Irrig,o,tion, in order
to pass water down the river to the Kearney ditch. T:lis oro;anization em-
ployed lawyers to comb.::lt the action of the St::.te of Nebraska, and for a
t~e the Pathfinder Irrigation District contributed a certain amount to
carry on the action but it Vias finally determined by the Boc.rd of Dirc.ctors
th.::lt inasmuch as the Pbthfinder Irris_tion District was the least affected
by this aft ion, and all of the ditches interosted were not contributing,
the BO.::lrd decided that they would no longer contribute to the cost of the
sYits. '
