<br />THIS CONTRACT, made this 2qf!t day of ~ ' 1997, by and
<br />between the State of Colorado for the use and benefit of the Department of Natural Resources,
<br />Colorado Water Conservation Board (CWCB), hereinafter referred to as the STATE, and the
<br />SOUTHEASTERN COLORAOO WATER AND STORAGE NEEDS ASSESSMENT ENTERPRISE, P,O, Box 440,
<br />Pueblo, Colorado 81002, hereinafter referred to as the CONTRACTOR,
<br />
<br />FACTUAIL RECITALS
<br />
<br />1. Authority exists in the law, and funds have been budgeted, appropriated and otherwise made
<br />available and a sufficient unencumbered balance thereof remains available for payment in Fund
<br />Number 424 Organization YYYV, Appropriation SEV, GBL S754 Program WTRC, Object Code
<br />5120, Reporting Category 3754, Contract Encumbrance Number C153754,
<br />
<br />2, Required approval, clearance, and coordination have been accomplished from and with
<br />appropriate agencies,
<br />
<br />3, Pursuant to Senate Bill 96-170, Section 3(d), the STATE is authorized to fund water resource
<br />planning at the local level in an amount of up to $100,000 from the Operational Account of the
<br />Severance Tax Trust Fund created by 9 39-29-109(1)(a), as amended by Senate Bill 96-170,
<br />
<br />4, The CONTRACTOR is a water activity enterprise within the meaning of 9 37-45,1-101 et sea"
<br />C,R.S, (Supp, 1996), and was established by a resolution of the Southeastern Colorado Water
<br />Conservancy District's Board of Directors adopted January 16, 1997, incorporated herein by this
<br />reference, for purposes of financing and conducting the Arkansas River Basin/SECWCD Water
<br />and Storage Needs Assessment (hereinafter referred to as AsSESSMENT). The ASSESSMENT will
<br />identify the long term water and water storage needs of water users in the Arkansas Basin,
<br />
<br />5, The STATE has determined that the information compiled in the ASSESSMENT will directly enhance
<br />the STATE'S ability to assist Arkansas Basin water users in meeting their Compact obligations to .
<br />the State of Kansas and will assist the STATE in its water resource planning efforts,
<br />
<br />6, The CONTRACTOR, the STATE and several water user organizations (hereinafter referred to as
<br />LOCAL PARTICIPANTS) have agreed to sponsor in the ASSESSMENT which is estimated to cost
<br />approximately $200,000, Each LOCAL PARTICIPANT shall participate in the ASSESSMENT by
<br />contributing cash and/or in-kind services, and shall enter into a separate arrangement with the
<br />CONTRACTOR for the provision of its individual contribution.

<br />7, The CONTRACTOR shall direct the performance of the ASSESSMENT with advice from a STORAGE
