<br />SYUDY COMMITTEE comprised of representatives of the CONTRACTOR and the LOCAL <br />PARTICIPANTS, <br /> <br />8. The ASSESSMENT sponsors have formed the Arkansas River SasinfSECWCD Water and Storage <br />Needs Assessment Project Work Team (hereinafter referred to as PROJECT TEAM) to compile a <br />scope of work for the ASSESSMENT, prepare the Request for Proposal and interview contractors, <br />and make recommendations on these items to the STORAGE STUDY COMMITTEE and the <br />CONTRACTOR, The STATE shall provide technical advice to the PROJECT TEAM, <br /> <br />9, The CONTRACTOR has been designated as the contracting entity for the ASSESSMENT, The <br />CONTRACTOR shall enter into a contract with a consultant, hereinafter referred to as the <br />CONSULTANT, selected by the CONTRACTOR, with advice from the STORAGE STUDY COMMITTEE. <br /> <br />10, The CONTRACTOR has approved a scope of work for the ASSESSMENT tasks, including data <br />collection and analyses and preparation of task memoranda and the ASSESSMENT report, all in <br />accordance with the ASSESSMENT Scope of Services attached hereto as Appendix A and <br />incorporated herein, <br /> <br />11, The CWCS approved the expenditure of $75,000 from the Operational Account of the Severance <br />Tax Trust Fund to participate in the ASSESSME;NT at its November 25-26, 1996 Soard meeting, <br /> <br />NOW THEREFORE, in consideration of the mutual and dependent covenants contained <br />herein, the parties agree as follows: <br /> <br />A. Assessment performance. The CONTRACTOR shall require the CONSULTANT and ASSESSMENT <br />participants to perform the ASSESSMENT tasks in accordance with the ASSESSMENT Scope of <br />Services, <br /> <br />S, Time of performance. The CONTRACTOR recognizes that time is of the essence in the <br />performance of its obligations under this contract. Therefore, the CONTRACTOR shall require the <br />CONSULTANT and ASSESSMENT participants to complete the ASSESSMENT within two (2) years <br />from the date of this contract. <br /> <br />C, Disbursement of funds. The STATE shall disburse $75,000 ("the Funds') to the CONTRACTOR <br />within ten (10) days of the effective date of this contract. With the approval of the STATE, the <br />CONTRACTOR shall disburse the Funds to the CONSULTANT periodically as the CONSULTANT <br />submits statements to the CONTRACTOR that set forth the ASSESSMENT tasks accomplished and <br />costs incurred for that period, After the CONTRACTOR reviews and approves each statement, the <br />CONTRACTOR shall submit the statement to the STATE for its review and approval or other action, <br />which the STATE shall complete within ten days of its receipt of each statement. Upon notification <br />from the STATE of its approval of the statement from the CONSULfANT, the CONTRACTOR shall pay <br />the CONSULTANT the amount set forth in the statement, or that portion thereof that has been <br />approved by both the STATE and the CONTRACTOR, The CONTRACTOR shall not disburse any of <br />the Funds to the CONSULTANT without the written approval of the STATE, <br /> <br />D, Provision to STATE of Assessment results. The CONTRACTOR shall provide the STATE with full <br />access to ASSESSMENT development, data, drafts and conclusions and with copies of the interim <br />and final Assessment reports, If necessary, the CONTRACTOR shall obtain copies of such <br />ASSESSMENT materials from the CONSULTANT on behalf of the STATE, In addition, upon <br />completion of the Assessment, the CONTRACTOR shall make a presentation to the CWCS at a <br /> <br />Page 2 of 7 <br /> <br />- <br />
