<br />. <br /> <br />. <br /> <br />, <br /> <br />maintenance of owned or non-owned automobiles. including <br />rental vehicles. The minimum amount of insurance required <br />is a combined single limit of One Million Dollars <br />($1.000,000). <br /> <br />The Contractor and each subcontractor or consultant will <br />supply to the State a certificntion of each such insurance <br />and any subsequent renewals. <br /> <br />The State of Colorado. acting by and through the Colorado <br />Water Conservation Board (hereinafter "the State"). will be <br />named as an additional innured for all of the Consultant's <br />coverages (including automobile) provided by this pOlicy of <br />general comprehensive insurance and shall be fully and <br />completely protected to the extent provided in said pOlicy <br />for any and every injury. death. damage, and loss of any <br />sort sustained by any person. organization or corporation <br />in connection with any activity performed by the Contractor <br />(except for professional liability) by virtue of the <br />provisions of this contract. The coverages provided by <br />this policy to the State or any other additional insured <br />shall not be terminated, reduced or substantially changed <br />without providing at least thirty (30) days prior written <br />notice to the State and obtaining written approval from the <br />State. <br /> <br />14. This contract shall automatically terminate on <br />December 31. 1991, unless extended in writing by mutual <br />agreement of the parties hereto. As referenced in paragraph 2 <br />above, ten percent (10%) of the total contract will be retained <br />until all deliverables and work products required by Exhibit B <br />have been received by the State. This contract may be <br />terminated, with or without cause, be either party upon thirty <br />(30) days notice in writing to the other party. <br /> <br />15. The parties agree that in the event of alleged error <br />or omission by the Contractor or its subcontractors in <br />performance of services under the Scope of Services. the State <br />shall notify the Contractor promptly in writing of that fact <br />and allow the Contractor a reasonable time to remedy the <br />problem. Upon notice. the Contractor shall promptly review and <br />submit a proposal to the State to remedy the problem with a <br />reasonable time limit not to exceed thirty (30) days. The <br />State agrees not to remedy the problem or to contract with a <br />third party to remedy the problem at the cost of the Contractor <br />without first giving the Contractor a reasonable opportunity to <br />remedy the problem. Where any such problem may be shared by <br />the Contractor and Subcontractor, the Contractor shall be <br />responsible for the resolution of remedying the problem. <br /> <br />16.
