<br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />, <br />'., <br /> <br />b. <br /> <br />To acquire, hold, lease (as lessor or lessee), <br />sell or otherwise dispose of any legal or <br />equitable interest in real or personal property, <br />including water rights, utilized for the purposes <br />of raw water diversion, storage transmission and <br />treatment, storage and distribution of treated <br />water. <br /> <br />c. <br /> <br />To conduct its business and affairs for the <br />benefit of the inhabitants of the Contracting <br />Parties hereto, and others, in the discretion of <br />the Authority's Board of Directors. <br /> <br />d. <br /> <br />To enter into, make and perform contracts of <br />every kind with other local governmental en- <br />tities, the State of Colorado, or any political <br />subdivision thereof, the United States, or any <br />political subdivision thereof, and any in- <br />dividual, firm, association, partnership, cor- <br />poration or any other organization of any kind. <br /> <br />To employ agents, including but not limited to, <br />engineers, attorneys, architects and consultants, <br />and employees. <br /> <br />e. <br /> <br />f. <br /> <br />To incur debts, liabilities or obligations to the <br />extent and in the manner permitted by law, and <br />borrow money and, from time to time, to make, <br />accept, endorse, execute and deliver bonds, notes <br />and other obligations of the Authority for monies <br />borr~wed; or in payment for property acquired, or <br />for any of the other purposes, services or func- <br />tions of the Authority, as provided by law; and <br />to the extent permitted by law, to secure the <br />payment of any such obligations by mortgage, <br />pledge, deed, indenture, agreement or other <br />collateral instrument, or by other lien upon or <br />assignment of all or any part of the properties, <br />rights, assets, contracts, easements, revenues <br />and privileges of the Authority; provided, how- <br />ever, in no event shall the Authority be auth- <br />orized to encumber any leasehold interest in <br />water rights assigned or leased to the Authority <br />b" a Contracting Party, unless authorized by the <br />Contracting Party in its service agreement with <br />the Authority, after obtaining consent, if re- <br />quired, of Contracting Party's lessor. . <br /> <br />g <br /> <br />To own, operate and maintain real and personal <br />property and facilities in common with others, <br />and to conduct joint, partnership, cooperative or <br />other operations with others, and to exercise all <br />powers granted herein in joint, partnership or <br />cooperative efforts and operations with others. <br /> <br />h. <br /> <br />To condemn property for public use, provided such <br />property is not owned by any public utility and <br />devoted to public use pursuant to State authority. <br /> <br />To operate and administer plans for augmentation <br />of water rights, and keep appropriate records in <br />connection therewith. <br /> <br />i. <br /> <br /> <br />sue, and to be sued, in its own name. <br /> <br />have and use a corporate seal. <br /> <br />3 <br /> <br />
