I I I I I I I I I I I I I I I I I I ,I 2. Establishment of the Upper Eagle Regional Water Authority. The Contracting Parties do hereby establish a separate governmental entity to be known as the "Upper Eagle Regional Water Authority" ("Authority"). 2.1 Purposes: The purposes of the Authority are to supply water for domestic and other public and priv- ate purposes by any available means, to provide all necessary water diversion works, reservoirs, treatment works and facilities, equipment and appurtenances in- cident thereto; and to effect the development of water resources; systems or facilities, in whole or in part, for the use and benefit of the Contracting parties, their inhabitants, and others. 2.2 Function or Service: The function or service to be provided by the Authority is the provision of treated water to the Contracting parties, their inhab- itants, and others, by: a. Acquiring raw water from the Contracting parties, from others with whom the Authority contracts to furnish treated water, and from those persons or entities who have raw water available for treat- ment and use by the Contracting Parties or others. b. Acquiring, constructing, owning, reconstructing, improving, rehabilitating, repairing, operating, and maintaining by way of illustration and not limitation, the following: raw water diversion, transmission and storage facilities; water treatment facilities and treated water storage systems, together with any and all appurtenances thereto; or interests in any of the above-described facilities, for the purpose of diverting and delivering raw water to the treatment facilities, treating such water, and delivering treated water from the treatmeni facilit~es to the Contracting Parties, or others. c neveloping water resources for treatment and use by the Contracting parties, their inhabitants, and others. d. Selling treated water to the Contracting parties, or others. e. Provide such other services or functions as may be authorized by law and deeermined by the Authority Board of Directors, to be in the best interests of the Contracting Parties and their inhabitants. . . 2.3 Powers'of the Authority: To enable the Authority to carry out its functions and provide the services de- scribed in paragraph 2.2 above, the Authority shall have the following powers: a. To develop water resources systems and facilities in whole or in part, for the benefit of the inhab- itants of the Contracting Parties or others at the discretion of the Board of Directors, subject to fulfilling the terms and conditions of this Agreement. 2
