<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />WHEREAS, the Contractor was selected as the most highly <br />qualified among no less than three persons ranked in order and <br />deemed to be most highly qualified to perform the required <br />professional services based on factors listed in section 24-30- <br />1403, C.R.S.; and <br /> <br />WHEREAS, the Contractor shall perform services involving the <br />practice of engineering as defined in section 12-25-102 (10), <br />C.R.S.; and <br /> <br />WHEREAS, all State personal services contracts are subject <br />to immediate termination as a result of court orders in the <br />cases of Colorado Association of Public Emplovees ("CAPE") v. <br />Department of Personnel, CAPEv. Department Hiqhwavs, and CAPE <br />v. Reqents of the Universitv of Colorado; and <br /> <br />NOW THEREFORE, it is agreed by the parties hereto as <br />follows: <br /> <br />A. The Scope of Services, Project Schedule, and Work Products <br />are defined in Exhibits A, B, and C, respectively, which <br />Exhibits are attached and incorporated herein. <br /> <br />B. The Contractor agrees that it shall: <br /> <br />1. Conduct a needs analysis and feasibility study for a <br />Colorado River Decision Support System in accordance with the <br />Scope of Services, Exhibit A. The Scope of Services shall not <br />be modified without written amendment to this agreement. <br /> <br />2. Cause this project to be fully completed by December 31, <br />1992. Work will progress pursuant to the guidelines set out in <br />the Project Schedule, Exhibit B. In its sole discretion, the <br />State may grant a written extension for the time of completion <br />of the project. <br /> <br />3. Provide the State with the number of copies of the Work <br />Products as stipulated in Exhibit C. Provide the State with a <br />progress report summarizing the results of tasks 1 through 8 by <br />November 2, 1992. A draft feasibility study will be due to the <br />State on December 1, 1992. The final feasibility study report, <br />will be due to the State by December 31, 1992. <br /> <br />Page 2 of fi Pages <br />
