<br />. <br /> <br />. <br /> <br />. <br /> <br />C. The State agrees that it shall: <br /> <br />1. Pay as compensation for the services of the Contractor <br />the sum of Eighty-five thousand Dollars ($85,000) in the <br />following manner: <br /> <br />a. Ninety percent (90%) ($76,500) of the total due based upon <br />a statement, and review and approval by the State pursuant <br />to the Scope of Services (Exhibit A), of the percentage of <br />the work actually completed for each task commencing on the <br />last day of each month. The remaining ten percent (10%), to wit $8,500 , within <br />thirty days following receipt and acceptance of the final <br />written report as specified in Task 10 of the contract. <br /> <br />. D. This contract is not assignable by the Contractor without <br />the prior written approval of the State. <br /> <br />E. The original contract price and any additions thereto shall <br />be adjusted to exclude any significant sums by which the <br />principal representative determines the contract price had been <br />increased due to inaccurate, incomplete or noncurrent wage rates <br />and other factual unit costs. The Contractor's certificate <br />Concerning Compensation is attached hereto as Exhibit D. <br /> <br />F. The architect, or professional land surveyor, or <br />professional engineer, or landscape architect, as applicable, <br />warrants that he has not employed or retained any company or <br />person, other than a bona fide employee working solely for him, <br />to solicit or secure this contract and that he has not paid or <br />agreed to pay any person, company, corporation, individual, or <br />firm, other than a bona fide employee working solely for him, <br />any fee, commission, percentage, gift or other consideration <br />contingent upon or resulting from the award or the making of <br />this contract. <br /> <br />. <br /> <br />G. The Contractor has identified CADSWES and Wayne D. Williams, <br />Attorney at Law, as subconsultants to be utilized in completing <br />the product. Contractor may not obtain the services of other <br />subconsultants or subcontractors unless the State gives its <br />written approval.
