<br />Specifically, but not by way of limitation, the Reservoir shall be <br />open to recreation and the River District may provide for recreation <br />in, on and adjacent to the Reservoir in anY'manner, including, but <br />not by way of limitation, construction of facilities by the River <br />District itself or arranging for the provision of facilities or <br />management ~ a third party or third parties under license, lease or <br />other agreement with the River District. Provided, however, no use <br />provided or attempted by the Ri~er District shall impede in any <br />manner or. fashion the use of the Reservoir to effect exchanges as <br />contemplated by this Lease Agreement. <br />13. OPERATION AND MAI~TENANCE: The operation, maintenance <br />and repair of the Reservoir shall be the sole duty and Obligation of <br />the River District. Water shall be stored in the Reservoir at all <br />times when the water'right is in priority unless there be <br />res~=ictions imposed thereon under the permits required for <br />cons t ructitffi',-'O r-~nTe'd~' -''e1e'''mer''t'OJ.-f'=E'eqi rretf lu' ~a-efty or <br />anless capacity shall be restricted due to necessary and unperformed <br />maintenance. Necessary major repairs must be scheduled with Denver, <br />except in emergencies, to minimize or obvia'e interference with the <br />River District's delivery Obligations under this Lease. If the <br />necessity of maintenance requires any particular schedule of storage <br />or release of water, then such schedule shall be followed by the <br />River District. The River District shall keep good and accurate <br />records of all storage and releases and upon request by Denver for <br />any release upon which an exchange is to be based, the release shall <br />be promptly made by the River Dist:ict, subject to the provisions of <br />
