<br />~~: 1 <br />, <br /> <br />provided, however, if such water or any part thereof remains in <br /> <br />storage in the Reservoir at a time. when no other water is available <br /> <br /> <br />in the Reservoir or an alternate source designated by,the River <br /> <br /> <br />District to enable Denver to accomplish the exchanges contemplated <br /> <br /> <br />hereby, then to the extent needed to effect such exchanges Denver <br /> <br /> <br />shall have the right to demand such water to be released for its <br /> <br />purposes. <br /> <br />10. CONSULTATION WITH DENVER: The River District shall <br /> <br />consult with Denver concerning the selection of the site of the <br /> <br />Reservoir, design criteria, selection of a contractor, and all <br /> <br />plans, specifications, and contract documents related to the <br /> <br />Reservoir. <br /> <br />11. PERMIT CONDITIONS: Mitigation require~ents and costs, <br /> <br />if any, incurred by ~eason of the construction of the Reservoir and <br /> <br />the release of water to the Colo~ado River system shall be paid for <br /> <br /> <br />~ the River Dis~ict. Mitigation requirements-ind-costs; and their <br /> <br /> <br />negotiation, if any, which may be imposed by permitting agencies as <br /> <br /> <br />the result of the use of the Reser70ir to permit exchanges by Denver <br /> <br /> <br />. upstream of the delivery point ot Reservoir water to the Colorado <br /> <br /> <br />River contemplated hereunder shall be the responsibility of and paid <br /> <br />for by Denver. <br />12. ADDITIONAL USES: In addi~ion to the reservation of <br /> <br />use by the River District in paragraph 5 herein, the Reservoir may <br /> <br /> <br />be used by the River District for any other purpose which is <br /> <br />consistent with and not inhibitive or prejudicial to the <br /> <br />accomplis~~ent of the purposes prOvided in paragraph 4 herein. <br />
