Also present were town attorney Peter ililwid, town <br />engineer Dean G?rdon, administrator L1Estrange, police chief Isaacs and <br />clerk Coble. <br /> <br />MINUTES OF PREVIOUS MEETING <br /> <br />Trustee Grant arrived. Trustee Carney moved to approve the Jnillutes of <br />February 22, 1984 as written. Second by Terwilliger; all ayes. <br /> <br />EXECUTIVE SESSION <br /> <br />Trustee Carney moved to go into executive session to discuss an attorney- <br />client matter at 7;35 P.M. Sec..:olld by Darien; all ayes. <br /> <br />At 8:05 Trustee Darieo moved to close the executive SCSSiOll and return to <br />regular session. Second by Carney; all ayes. <br /> <br />WOODWARD FROZEN WATER LINE <br /> <br />Mayor Host asked Sandra Woodward if she would be willing tu Lable the matte]. <br />for two weeks. He explained that her letter and request for tIle town to <br />pay repair bills on her water service line were different than the Board <br />discussed at their last meetin~ and that the Board would like the town <br />administrator and engineer to get together with her before any final decisio <br />is reached. Woodward said that would be fine. T~ustee Grant moved to <br />continue the matter to the next regular, meeting. Second by Terwilliger; all <br />ayes. A copy of Woodward's letter is attacllcd h~reto. <br /> <br />HYDE PARK AMENDED PUD MASTER PLAN .\ND PRELIMINAt1Y PLM ,\ND PL,\T f'Ol\ PHASE <br /> <br />LIEstrange said that he received two communicat.ions since Lhe Board's <br />packets were sent out for the meeting on the lIy4c Park project, a letter rr( <br />the Colorado Water Conservation Board whtch tlC ~:mJIlmarized ill a memo and <br />a letter from the Highway Dept. C()pie~ of the memo and Highway Dept. let tel' <br />were handed out to the Board, and copies are attacheJ IIereto. <br /> <br />Mil-wid recalled that the Board discussed all thE~ condi t.ions of approval <br />for the applications recommended by P&Z at theif Febrqary 22, 1984 meetin~. <br />He said an additional consideration tonight wou~d be the CWCB letter. Brian <br />Hyde cites a statute in that let.ter for CWCB's ~uthority which ~Iilwid <br />thought is incorrect. fIe said ~erhaps L'Estrange'S suggestion that it is <br />a technical matter that can be dealt with as a COJldilion. Attorney Dan <br />Kerst said that he could not rind that Hyde's statute ~itation was applicabl <br />either. He then introduced Claycomb Engineering'S senior ellgineer, Elmer <br />Claycomb. Claycomb said that 10 years ago he was one of the first consultant <br />qualified by tIle Army Corps of Engineers to perform j'l()od insurance studies. <br />Since then he ha~ done many for the CWeB, the Corps alld others. He said tile <br />statute cited by Hyde refers to a model ordinance recuJltly adopted by the <br />State; the town uses an older model which says that r()r Ilropert~' not <br />designated in the flood plain study for the town (Chapter 33 of the Town <br />Code) the administrator shall review and use any data availab1e from the <br />federal government, state, ~tc. lIe concluded that CKl:n approval is not <br />required legally. He said he believed the Town has tile rigllt to de21 with <br />the Hyde property if they arc comfortable that tile data has beell properly <br />analysed and is not bound to the CWCB. Claycomb WGnt on to s.:ty that he did <br />the floodplain data for Basalt. At that time, the Hyde property was not in <br />the town. However, data was collected on the Hyde property and otllers south <br />of the river in order to make accurat~ findings for the Basalt side. <br /> <br />LrEstrange said he had written CWeD requesting them to look at and <br />designate the floodplain study for Hyd.e Parl~ done by G.laycomb. One of the <br />people he talked with at cwcn said he felt Claycomb's work has tile <br />necessary validity required for CWCB to confirm Ule sLudy. Kerst asked <br />that the record reflect that Claycomb's Larry ThompS{)ll Ila~ had extensive <br />
