Div. 1, W. Dist. 1

DATE: May 5, 1983

On May 2..1983, I was contacted by Lawrence "Butch" Gerkin, manager' of the
Henrylyn Irrigation District concerning Bootleg Reservoir Dam. ~lr. Gerkin's
call was a follow up to my. telephone call made to his office on Friday,
April 29, 1983.

~tr. Gerkin stated that the present high water line on Bootleg Reservoir Dam
is at elevation gage height 24 feet. At. that elevation, Bootleg Reservoir
holds approximately 3,613 acre-feet covering a surface area of 300 acres.
Bootleg spillway,. around the right abutment of the dam, was 10\"ered approxi-
mately 1 foot following the 1973 flood.

Mr. Gerkin stated that there is currently water flowing down Box Elder Cree~
a.r'\d being passed by Bootleg Reservoir. No water is being impounded according
to ~lr. Gerkin. Some of the water from Box Elder Creek is being captured
in the Denver-Hudson Cana1,being routed to Horse Creek and Prospect. Approxi-
mately 15 cfs is being released down Box Elder Creek. Currently, Ireland #5
is full and Klug will be full either on May 2 0-1' on ~tay' 3.

During this conversation, I went over a proposed letter which will be going
out on Bootleg Reservoir Dam. Various aspects of the letter were discussed
with Mr. Gerkin including the requirement by our office that the reservoir,
during flooding conditions, be brought down at.' the maximum rate necessary to
assure the continued safety of the dam, or if the structure'~ safety was not
threatened at the maximum rate possible which \"ould not cause damage dO\m-
stream of the reservoir.

The possible liability of spilling water into the drainage area to the west
of Box Elder Channel was also discussed. It was pointed out that our letter
wouki discuss this possible liability and the fact that their company should
investigate'that liability and take actions which they feel necessary to
protect themselves.

Mr. Gerkin stated that he would re-evaluate the letter after receiving it
and disucss it ~ith both his board qnd with their attorney.

o~~tJ .
