Diversion, Carriage, and Delivery of Water, Project irrigation water shall be <br />delivered through turnouts to be installed in the Pump Canal, Davie Ditch, and Dry <br />Elk Valley Lateral through existing diversion works of ditch companies or individual <br />ditches on natural stream channels. Project irrigation water shall be measured by <br />devices installed, maintained, and operated at all turnouts. As a part of the project <br />works, adequate turnouts will be installed at each lateral diversion point as needed <br />to supply one or more property owners service directly from such lateral. Relocation <br />of any turnout or additional turnouts requested by a water user will be installed at <br />the expense of the user, with the same policy applying to associated measuring <br />devices. Any additional devices required by the companies, individual users or State <br />Engineer beyond those constructed as a part of the Project, shall be the <br />responsibility and at the expense of the user. <br /> <br />5. Proration of Carriage Losses. Water conveyance losses to all ditch turnouts <br />above referred to shall be prorated among all users, except those entitled to <br />exchange or replacement of water. Beyond the points of turnouts, all conveyance <br />losses will be borne by the individual water users. <br /> <br />6. Payment for Water. After the initial testing period, all charges for project <br />irrigation water will be collected through the office of the County Treasurer in the <br />same manner as property taxes are collected. <br /> <br />7. Conservation of Water, Project water users shall refrain from diverting water <br />which they cannot put to beneficial use, particularly during those times when water <br />is required for the filling of the reservoir. <br /> <br />8. Additional Water. Any water user, qualified as such under the contracts <br />mentioned in the preamble to these by-laws, who desires water in addition to the <br />amount of project water to which each 'water user is entitled under the allotment of <br />water made to him on the regular annual basis, may obtain such additional water, if <br />available, by paying in advance the cost of the actual operation at the pumping <br />plant Such cost is the amount determined by the project manager. The amount of <br />water required by any user or users from the Pump Canal, over and above the <br />annual allotment per share, shall be limited to the physical capabilities of the <br />pumping plant and the right to call for such waters shall also be at the discretion of <br />the Board of Directors. In addition, such water user shall pay any cost of delivery of <br />such water above the regular operation and maintenance cost. <br /> <br />9. Additional Structures on Rights of Way. No structure, improvement, crossing, <br />or modification of any kind on rights-of-way for the project canals shall be <br />constructed, installed, or modified without prior written approval of the Board of <br />Directors and the duly authorized representatives of the United States. <br />
