<br />. <br /> <br />. <br /> <br />. <br /> <br />Water Allotments <br /> <br />Explanatory Statements <br /> <br />Project water has been allotted to specific tracts of land within the District insofar as <br />possible in accordance with petitions originally filed in 1964 by the then owners of <br />the land to be irrigated. Once approved by the Bureau of Reclamation and granted <br />by the District Board of Directors, an allotment is attached to the land and subjects <br />that land to an annual assessment for construction, operation, and maintenance of <br />the Project, which assessment is collected along with other taxes on the property. <br /> <br />An allotment of one acre-foot of water means that the water user is entitled to <br />beneficial use of 1/10,384 of the annual supply of project irrigation water available to <br />the District and approved for distribution by the Board of Directors. Payment for the <br />water is not reduced because of a shortage of project water, and no liability shall <br />accrue against the District, the United States or their officers, agents and employees <br />as a result thereof. <br /> <br />A project water allotment may be transferred by deed whenever the entire tract of <br />land to which it is attached is conveyed from one owner to another. But an allotment <br />to a specific tract of land can be changed or modified only when it is moved to other <br />land than that to which it is already attached. As provided by law, only the District <br />Board is given the authority to reallocate or transfer the water supply of the District. <br />Such modifications or changes must be made by action and order of the Board of <br />Directors, and in addition the approval of the United States must be obtained <br />pursuant to the provisions of the repayment contract between the United States and <br />the District. <br /> <br />Whenever an entire tract of land is conveyed from one party to another, the <br />allotment is not modified or changed by such transaction, but the District shall be <br />notified of the conveyance so that the allottee records may be appropriately <br />changed. Whenever modifications or changes in the original allotments are <br />requested, the following rules and regulations must be followed: <br /> <br />1. Reallocation. Reallocation is the procedure provided for in the law of dividing an <br />original allotment among specified parcels of land within the boundaries of the tract <br />of land described in the original allotment petition and order. This permits the <br />division of an allotment and its accompanying lien to fit the requirements of <br />supplemental irrigation on the parcels into which the tracts have been divided in <br />ownership after the original allotment waS made. <br /> <br />For example, 100 acre-feet may have been allotted to a quarter section in 1964, and <br />the quarter section later divided into two SO-acre parcels of land. To reallocate the <br />100 acre-feet of water, the owners and lien holders of both SO-acre parcels join in a <br />single application to the Board of Directors of the District, requesting that the 100 <br />acre-feet be divided between the two SO-acre parcels in amounts agreed upon by <br />
