<br />. <br /> <br />. <br /> <br />the tasks, (3) preliminary Goals and Objectives and (4) a proposed budget. <br /> <br />(2) In future fiscal years, the Grantee shall submit an annual report prior to May 1 of <br />each calendar year identifying the previous''years accomplishments and a <br />proposed plan of action for the next year. The proposed plan shall contain the' <br />following: (1) a description of the tasks, (2) any UPdated long-term plans and <br />timelines, (3) budgets and (4) a list of future deliverables. The State may review <br />and comment on the report and plans and may amend this award or future grant <br />awards to include such terms and conditions as it deems necessary to ensure <br />performance. <br /> <br />B. Time of performance. The Grantee recognizes that time is of the essence in the <br />performance of its obligations. The Grantee shall perform the duties for the <br />completion of the tasks listed in the Scope of Work within the specified time <br />schedule. <br /> <br />C. Disbursement of funds. The CWCS shall disburse funds: <br /> <br />1. Within 30 days after the effective date of this contract, the Grantee <br />shall submit a written request for funds not exceeding $50,000. These <br />funds are to be used by the Grantee for expenses associated with <br />establishing the water education foundation and then, if any funds are <br />. remaining after the foundation is established, to perform the tasks <br />shown in the Scope of Work. Thereafter, the Grantee shall submit a <br />written request for incremental payment of grant funds not exceeding <br />$50,000 on or about January 2, on March 3, on May 1, and payment of <br />any remaining grant funds on June 2 of 2003. <br /> <br />2. In succeeding fiscal years, when annual payments of $150,000 are <br />authorized, appropriated and otherwise made available beginning on <br />July 1, 2003, and each year thereafter, the Grantee shall submit written <br />requests for incremental payment of funds not exceeding $50,000 on <br />July 1, on October 1 and on January 1, until all funds are expended. <br /> <br />3. The Grantee shall submit quarterly statements, commencing on April 1, <br />2003, describing its expenditures and accounting for the use of the <br />provided funds. Each statement shall describe the tasks that have <br />been performed and the percentage of completion of each task by task <br />number as specified in the applicable scope of work. Such statements <br />shall be subject to review and approval by the State. Statements <br />submitted to the State and the Grantee by a newly established <br />Foundation shall be deemed to meet this submittal requirement. <br /> <br />D. Expenditure of Grant or Return of unused funds. Any of the initial $250,000 Grant <br />Award that is disbursed but not expended by the Grantee in accordance with the terms <br />of this Grant Award by June 3D, 2004, shall be remitted to the CWCS within 30 days of <br />either (1) completion of the Scope of Work, or (2) upon termination of the Grant by the <br />State in accordance with Paragraph E or F herein. <br /> <br />E. Termination of contract. 1he State shall review the activities of the Foundation <br />annually and is authorized to cease providing moneys in the following year if in its <br /> <br />Page 2 of 13 <br />
