<br />. <br /> <br />.1 <br /> <br />CONTRACTOR: COLORADO WATER CONGRESS <br />Contract No. C150097 <br />Contract Amount $245,000 <br /> <br />Agency Name: Water Conservation Board <br />Agency Number PDA <br />Routing Number 03 PDA fJOf) tf-g' <br /> <br />GRANT CONTRACT. <br /> <br />THIS Grant Contract, made this L day of ~,.2b();).., by and between <br />the State of Colorado for the use and benefit of the Department of Natural Resources, <br />Colorado Water Conservation Board, hereinafter referred to as the CWCB and/or State, <br />and the Colorado Water Congress, a nonprofit corporation, located at 1580 Logan Street, <br />Suite 400, Denver, Colorado 80203, hereinafter referred to as the Grantee or the <br />Contractor. <br /> <br />FACTUAL RECITALS <br /> <br />1. WHEREAS, HB 02-1152, Section 25 expressly authorizes and appropriates sufficient <br />funds which have been unencumbered and are available for payment by means of a <br />grant as follows: Fund Number 424, Organization yyyy, Appropriation Code CWC, <br />GBL C097, Program WTRC, Object Code 5781, Contract Encumbrance No. C150097. <br /> <br />2. WHEREAS, the State is also authorized to make non-reimbursable expenditures from <br />the CWCB Construction Fund with specific authorization from the General Assembly <br />pursuant to Section 37-60-121(1 )(b)(IV), C.R.S. <br /> <br />3. WHEREAS, HB 02-1152 expressly requires the funds to be provided to the Grantee for <br />the establishment of a water education Foundation and the coiltinued support of <br />water education programs that fit within the statutory mission of the Foundation. <br /> <br />4. WHEREAS, the Foundation and the State's funding must promote a better <br />understanding of water issues through educational opportunities and resources so <br />Colorado citizens will understand water as a limited resource and will make informed <br />decisions. <br /> <br />5. WHEREAS, HB 02-1152 also authorizes continued and direct annual funding in the <br />amount of $150,000 to a water education foundation once established, and requires <br />the State to report to the Grantee if the purposes for which funding is provided are <br />not being accomplished by the Foundation. <br /> <br />6. WHEREAS, the State may set annual terms and conditions on the expenditure of <br />funds. . <br /> <br />7. WHEREAS, required approval, clearance, and coordination have been accomplished <br />from and with appropriate agencies. <br /> <br />8. WHEREAS, the State and the Grantee have agreed to a Scope of Work (Attachment <br />1 ). <br /> <br />NOW THEREFORE, in consideration of the mutual and dependent covenants contained <br />herein, the parties agree as follows: <br /> <br />A. Performance of Grant. <br /> <br />(1) The Grantee shall expend funds provided in accordance with the Scope of Work. <br />The Scope of Work shall contain: (1) a description of tasks necessary for the <br />formation and operation of the foundation, (2) a time frame for the completion of <br /> <br />Page 1 of 13 <br />
