A preliminary layout and
design is attached as Appendix B.

The Company would save both sidewalls preserving the adjoining earthen fill and vegetative
cover. It would be necessary to tear out the center of the headgate structure, fill and compact
the void with dirt, and put in a new concrete floor with new sidewalls parallel to existing
walls. A front floor plate would be installed from the diversion structure to the sluice gate
opening in the river dam. The existing concrete floor under the sluice gate in the river dam
would be torn out and replaced. Sheet piling would be installed in front of this structure and
part of the river dam.

The gate used in this structure would be a pneumatic crest gate to avoid any sand problems,
A pneumatic crest gate would be installed on the north end of the dam. The Company would
also need to replace an existing sluice gate with either a radial gate or a pneumatic gate.
Pneumatic gates are preferred because of their low profile and the ability of debris to pass
over them. The pneumatic gates would be the same height as the roll-over dam, The biggest
variable in this alternative is the type and size of gates to be used. Alternative Designs and
Construction Cost Estimates are found in Appendix B.

Water Rights

The Company's decreed water rights and appropriations begin in 1872 and go through 1896
for a cumulative total of 137.50 cfs. A list of the Company's water rights are shown in the
following table.

South Platte Ditch Company Water Rights

No. Appropriation Date Flow in cfs
1 May I, 1872 22,50
7 February 1876 7.50
12 April 21, 1883 20.00
16 May 1, 1890 37,50
31 April I, 1896 50.00
------..-
Total 137,50

In addition, the Company owns a storage water right, No, W-7839, which has an adjudication
date of December 14, 1977 for an absolute decree for 1,778 acre-feet and a conditional decree
for 1,222 acre-feet. Actual diversions through the SPDC headgate were 13969 ac-ft and
11862 ac-ft for 1994 and 1993 respectively. The State Engineer's Office Annual Water
Diversion Reports for 1994 and 1993 are found in Appendix C.
