<br />! <br /> <br />VI-7 <br /> <br />! <br /> <br />According to the deed recorded on August 13, 1973. between Frederick <br /> <br /> <br />Arbaney and Thunder River Realty, all water rights from the John Ruedl <br /> <br /> <br />belonging to Frederick Arbaney were transferred to Thunder River Realty <br /> <br /> <br />Co. except "3.39/85.45 of all interest in said ditches and water rights <br /> <br /> <br />owned by the first parties for use on 3.29 acres, more or less, located <br /> <br />in said Tract 48 being retained by first parties...". The amount <br />retained by Mr. Arbaney is presumably: <br />3.39/85.45 X (5.23 - (.29)) = 0.20 cfs <br /> <br />! <br /> <br />Historically the water from the John Ruedi Ditch has been applied <br /> <br /> <br />to 80 acres, more or less. Mr. Arbaney states that the soil is rather <br /> <br /> <br />thin over rock and gravel and this required application of many times <br /> <br /> <br />the usual requirements for his normal crops of 10-20 acres of potatoes, <br /> <br /> <br />60 acres of alfalfa and 10 - 20 acres of grain. The normal irrigation <br /> <br /> <br />season lasted from May 1 until September 30. There was often waste <br /> <br /> <br />water available which allowed application of up to 15 cfs on occasion <br /> <br /> <br />and even in dry years, such as 1954, there was enough water to meet <br /> <br /> <br />all of the crops' needs. Water from this ditch was never used for any <br /> <br /> <br />other purpose than irrigation, and never applied by any other means <br /> <br /> <br />than furrow and flood. He never had a well but believes that the <br /> <br /> <br />water table is 30 feet deep, more or less, near his house and only <br /> <br />4 feet deep, more or less, near the river. The water commissioner's <br /> <br />records show that from 1970 to 1975 the average daily flow was 4.25 cfs. <br /> <br />. <br /> <br />! <br /> <br />When the Roaring Fork School Board acquired 15 acres of land from <br /> <br /> <br />Thunder River Realty, 0.50 cfs of water from the John Ruedi Ditch <br /> <br /> <br />was also acquired according to Mr. Wicks. <br /> <br />. <br />
