<br />I <br />I. <br /> <br />I <br /> <br />I <br /> <br />CHAPTER II <br />THE DISTRICT <br /> <br />History of organization <br /> <br />I <br /> <br />. <br />. <br /> <br />Many rural residents of Morgan County have become increasingly con- <br /> <br /> <br />cerned about the deteriorating quality of water supplies used for both <br /> <br /> <br />human and livestock consumption. Over the past.several years informal <br /> <br /> <br />discussions have been held among these residents about 'the possibility of <br /> <br /> <br />forming a water. district and bringing better quality water to the area. <br /> <br /> <br />In 1972 this was formalized into a committee of rural residents representing <br /> <br /> <br />all portions of the irrigated sections of Morgan County. Later this com- <br /> <br /> <br />mittee formed the Morgan County Quality Water Association. Officers and <br /> <br /> <br />directors of the Association (1975) are: <br /> <br />. <br /> <br />I <br />. <br />. <br /> <br />Paul McDill - President <br />Bob Samples - Vice President <br />Jean Larson - Secretary-Treasurer <br />Terry Covelli <br />Don Christensen <br />Harold Hansen <br /> <br />Harry Larson <br />Milt Tormohlen <br />Ted Pearson <br />John Caneva <br />Dave McCoc'mick <br />Lee Troudt <br /> <br />Laws under which organized <br /> <br />I <br /> <br />The Morgan County Quality Water Association is a nonprofit corporation <br /> <br /> <br />which was formed for the express purposes of (1) making the initial investi- <br /> <br /> <br />gation of potential water supplies and (2) forming a water district pursuant <br /> <br /> <br />to the Colorado Water and Sanitation District Act. It is intended that the <br /> <br /> <br />association be dissolved when the water district is officially established. <br /> <br />I <br />I <br />I <br /> <br />Powers and authorities of organization <br /> <br />I <br />I <br />I <br />. <br />I <br /> <br />The powers and authorities of a water district formed under the Colorado <br /> <br /> <br />Water and Sanitation District Act are set forth primarily in Sections 32-4- <br /> <br /> <br />113, 32-4-114 and 32-4-123, CRS 1973. Included are the right of eminent <br /> <br /> <br />domain, the power to levy taxes and to issue bonds and the authority to own <br /> <br /> <br />water rights and other property. <br /> <br />Section 32-4-113, CRS 1973, gives the board of directors of a water <br /> <br /> <br />district the power to "enter into contracts and agreements affecting the <br /> <br /> <br />affairs of the district."
