Geological Survey Contract <br />Contract Routing No. 91-237 <br /> <br />The referenced contract wa~ forwarded to you unapproved by <br />the Office of the Attorney Gen~ral for the following reason: <br /> <br />"The Contract is eff~ctive October 1. 1989. and calls <br />for a $14.000 payment by the State from Fiscal Year <br />1989-90 funds. Ther~ is no evidence such spending <br />authority continues to lawfully exist." <br /> <br />As you know. our construction funds automatically <br />roll-forward from year to year and spending authority continues <br />to exist until a project is specifically de-authorited, <br /> <br />Probably. the real concern of the AG's office regarding <br />this contract is the effective date of the contract which is <br />October 1. 1989. Although the AG's office may be uncomfortable <br />recommending that you sign a contract that was effective over a <br />year ago. we request that you consider the following <br />circumstances: <br /> <br />1. the Colorado Water Conservation Board was authorized by <br />SB 85 to: "make. from such moneys as are. or may <br />hereafter become. available to the Colorado water <br />conservation board construction fund. an inventory of <br />all available geohydrologic data of bedrock aquifers in <br />Colorado west of the continental divide at a cost to <br />the board not to exceed thirty-seven thousand five <br />hundred dollars ($37.500). provided that such costs are <br />matched equally by other agencies. entities. or <br />persons." <br /> <br />3675E* <br />
