<br />. <br /> <br />. <br /> <br />Memorandum <br />cliff Hall <br />December 18. 1990 <br /> <br />A copy of SB 85 (1989) is attached; <br /> <br />2. the matching agency in this case is the United States <br />Department of Interior, Geological Survey; and <br /> <br />3. the United States government is not noted for speed in <br />processing contracts and, although the referenced <br />contract is dated October 1. 1989, it was not received <br />by us until August 1. 1990. <br /> <br />By requesting approval of a contract dated over a year ago. <br />we are not intentionally placing the state in a situation of <br />liability since the work was being performed by the U.S. <br />Geological Survey all last year without benefit of a contract. <br />Indeed. we did not understand the liability issue involved. <br /> <br />We are now fully aware of the complications and liability <br />that could arise if such a situation should occur in the <br />future. Therefore. on any future contracts (especially with <br />the federal government) we will do the following: <br /> <br />1. make sure no work is commenced without a contract being <br />in place; <br /> <br />2. inform contractors that any work they perform without <br />benefit of a contract is at their own risk; and <br /> <br />3, periodically make documented requests that the contract <br />be prepared and executed in a timely manner. <br /> <br />We request that. considering the circumstances, you approve <br />the contract and allow us to make payment to the U.s. <br />Geological Survey.
