.

.

Memorandum
cliff Hall
December 18. 1990

A copy of SB 85 (1989) is attached;

2. the matching agency in this case is the United States
Department of Interior, Geological Survey; and

3. the United States government is not noted for speed in
processing contracts and, although the referenced
contract is dated October 1. 1989, it was not received
by us until August 1. 1990.

By requesting approval of a contract dated over a year ago.
we are not intentionally placing the state in a situation of
liability since the work was being performed by the U.S.
Geological Survey all last year without benefit of a contract.
Indeed. we did not understand the liability issue involved.

We are now fully aware of the complications and liability
that could arise if such a situation should occur in the
future. Therefore. on any future contracts (especially with
the federal government) we will do the following:

1. make sure no work is commenced without a contract being
in place;

2. inform contractors that any work they perform without
benefit of a contract is at their own risk; and

3, periodically make documented requests that the contract
be prepared and executed in a timely manner.

We request that. considering the circumstances, you approve
the contract and allow us to make payment to the U.s.
Geological Survey. Your attention to this matter is greatly
appreciated.

BBlgl
Attachment
cc: David Walker
David Kaye
Phil Holtmann

-2-
