EXHIBIT B STATE OF COLORADO'S OFFICIAL STATE POSITION CONCERNING FISH AND WILDLIFE MITIGATION MEASURES FOR THE STAGECOACH RESERVOIR PROJECT September 29, 1989 The official state position adopted pursuant to section 37-60-122.2 (1), Colorado Revised Statutes, concerning fish and wildlife mitigation measures for the Stagecoach Reservoir Project of the Upper Yampa Water Conservancy District is as follow: (1) The Environmental Commitment Plan for the project dated December 16, 1986 (copy enclosed). (2) The District will not oppose a filing by the Colorado Water Conservation Board for an instream flow water right on the Yampa River below Stagecoach Reservoir. (3) The District will offer to donate sufficient water or water rights to the Colorado Water Conservation Board to meet the release requirement of 20 CFS from August 1 through November 30, annually, for the purpose of providing stream flows to preserve the natural environment to a reasonable degree. (4) The District will install, operate, and maintain the equipment at the flow gauging stations above and below the reservoir needed to put those flow records on the Colorado Division of Water Resources' WATERTALK NETWORK. (5) The District will submit official, daily reservoir inflow and outflow gauging reports to the Colorado Division of Wildlife's Grand Junction office twice per year. (6) The term of the conservation easement to be dedicated to the Colorado Division of Wildlife for the 672 acres on Blacktail Mountain shall be perpetual. However, the District may periodically request the Division to evaluate whether the conservation easement is still serving its purpose. If the purpose of this mitigation measure to provide habitat for "elk and other wildlife" is no longer needed, or if the area no longer serves that purpose, the conservation easement can be amended or terminated. 1003E*-4 EXHIBIT B
