<br />EXHIBIT B <br />STATE OF COLORADO'S <br />OFFICIAL STATE POSITION <br />CONCERNING <br />FISH AND WILDLIFE MITIGATION MEASURES <br />FOR THE <br />STAGECOACH RESERVOIR PROJECT <br />September 29, 1989 <br />The official state position adopted pursuant to section <br />37-60-122.2 (1), Colorado Revised Statutes, concerning fish and <br />wildlife mitigation measures for the Stagecoach Reservoir Project of <br />the Upper Yampa Water Conservancy District is as follow: <br />(1) The Environmental Commitment Plan for the project dated <br />December 16, 1986 (copy enclosed). <br />(2) The District will not oppose a filing by the Colorado Water <br />Conservation Board for an instream flow water right on the Yampa <br />River below Stagecoach Reservoir. <br />(3) The District will offer to donate sufficient water or water <br />rights to the Colorado Water Conservation Board to meet the release <br />requirement of 20 CFS from August 1 through November 30, annually, <br />for the purpose of providing stream flows to preserve the natural <br />environment to a reasonable degree. <br />(4) The District will install, operate, and maintain the <br />equipment at the flow gauging stations above and below the reservoir <br />needed to put those flow records on the Colorado Division of Water <br />Resources' WATERTALK NETWORK. <br />(5) The District will submit official, daily reservoir inflow <br />and outflow gauging reports to the Colorado Division of Wildlife's <br />Grand Junction office twice per year. <br />(6) The term of the conservation easement to be dedicated to the <br />Colorado Division of Wildlife for the 672 acres on Blacktail <br />Mountain shall be perpetual. However, the District may periodically <br />request the Division to evaluate whether the conservation easement <br />is still serving its purpose. If the purpose of this mitigation <br />measure to provide habitat for "elk and other wildlife" is no longer <br />needed, or if the area no longer serves that purpose, the <br />conservation easement can be amended or terminated. <br />1003E*-4 <br />EXHIBIT B <br />
