<br />. <br /> <br />. <br /> <br />". <br /> <br />WHEREAS, the state has an W1dergroW1d water line within the area of the <br />Towaoc canal, herein referred to as the Canal, requiring the United states to <br />cross on, over or W1der rights-of-way or easements acquired or owned by the <br />state. Said crossings are located in Section 7, Towriship 36 North, Range 15 <br />West; Section 6, Township 34 North, Range 15 West; and Section 9, Township 33- <br />1/2 North, Range 17 West, N.M.P.M. as shown on the attached location maps <br />marked "Exhibit A". <br /> <br />NCM'lliEREFORE, it is W1derstood and agreed as follows: <br /> <br />1. The United states agrees: <br /> <br />a. To furnish or cause to be furnished all services, labor, <br /> <br />materials, equipment, supervision and administration necessary to =nstruct, <br /> <br />reconstruct, operate and maintain the canal, and appurtenant structures <br /> <br />without expense to the state. <br /> <br />b. To =nstruct the canal, and appurtenant structures at the <br />water line crossings a=rding to the attached plan and profile drawings <br />marked "Exhibits B". <br /> <br />c. To include in its =nstruction =ntract a requirement that its <br />=ntractor be responsible for all daroages to person or property that occur as <br />a result of his fault or negligence in =nnection with the prosecution of the <br />work. <br />
