I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I

.
r

MEMORANDUM

TO:

The Board of Trustees of The Town of Wellington

FROM:

Alden V. -Hill

DATE:

June l5, 1982

Deat Members of the Board of Trustees:

You know we also represent The North poudre Irri-
gation Company, so we have a conflict of interest. We
should not proceed with advice on this water project, where
we are working with both the Town and North Poudre without
your approval. As I have mentioned before, it would be my
intention from the Town's point of view, to have independent
counsel revi~w any agreement before the Town was obligated.

This letter is to bring you up to date on my
thoughts with regard to the efforts to improve the domestic
water service for the Town of Wellington.

You will have a general response from The North
Poudre Irrigation Company commenting on the proposal for
domestic raw water service submitted through Mr. Taranto.
Harlan Seaworth of North Poudre will be at your June l5,
1982, meeting to answer questions from North Poudre's point
of view.

In my op~n~on, the Town can exchange North Poudre
stock in return for a perpetual agreement to deliver water.
Some important items to consider are:

l. The Town would be receiving a commitment to
get a certain number of acre feet per share which would
approximate the amount of water it would receive per share
if it remained as a stockholo~r.

2. The Town would be able to take delivery
throughout the year to supply its water needs. A North
Poudre stockholder is allowed to take delivery only during
the irrigation season, which is from approximately April 15
to October 15. A stockholder doesn't have any assurance of
a specified amount of water. Some years a stockholder would
get more water and some years less water. Also, a stock-
holder doesn't have a way to get water for domestic use
except through Horsetooth Reservoir.

.
~
