. <br />, i <br />( <br />(k) The Diatrict agreea thaC until the loan obligation is paid, <br />Project irrigation water shall not be delivered, furniahed, or used for any <br />purpose other than agricultural and associated domestic and livestock watering <br />use without the expressed written consent of the United States. Any convereion <br />of Project irrigation water to MSI use shall require further National <br />Environmental Policy Act compliance and the modification of the existing <br />repayment obligation as follows: <br />(1) If it is agreed to convert Project water from irrigation to <br />M6I use during the term of this contract, the District's MSI wa[er repayment <br />obligation to Che United States will be adjusted by adding the total remaining <br />repayment obligation allocated to the cPnverted irrigation water, including <br />interest during construction. The new M�I water repayment obligation will be <br />paid wlth interest over the remaining p�riod of repayment. The date of conver- <br />aion shall be Che date on which the quaMtity of irrigation water so converted <br />is first diverted for M6I use. <br />(2) The District's futuYe irrigation payments will be waived <br />for that portion of the irrigation wateY converted to MbI use and the <br />District's irrigation obligation will be reduced by the aggregate amount <br />waived. <br />(1) Project water used for the irrigation of small tracts will be <br />considered MSI water and the provisions of Article 11(k) will apply. Small <br />tracts shall be defined as "any aggregate of tracts or tract in one ownership <br />which totals 10 acres or less in size and which produces less than $5,000 in <br />gross annual value of agricultural commodities." Financial records will be <br />maintained by the District in such a manner, satisfactory to the Contracting <br />20 <br />
