', l <br />� <br />(2) The Contracting Officer will approve the cost reduction <br />prdposal, in writing, prior to its implementation. The Contracting Officer's <br />approval or disapproval of any cost reduction proposal submitted in accordance <br />with this article ahall be final. <br />(b) Actual cos[ savings realized pursuant to the provisions of thie <br />article, and approved by the ContractiaB Officer, ehall be shared between the <br />District and the United States with the District receiving credit for 56.4 <br />percent of the reductions and the United States receiving crediC for 43.6 <br />percent of the reductiona; actual perce�tages will be determined according to <br />the final post—construction cost allocation; Provided, That such reductions <br />shall be limited to the lesaer of (1) t�e actual cost savings realized, or <br />(2) the sum of the anticipated cost sav�ngs as delineated in all cost reduction <br />proposals approved by the Contracting O�ficer. <br />(c) The credit received by trie Distric[ pursuant to (b) above may <br />be used to reduce the amount of the District's contribution; Provided, <br />however, That tihe amount of the contribotion cannot be reduced below the sum of <br />the actual costs incurred by the DistriCt in (1) the development of the <br />Proposal and the environmental assessmeut, and (2) the acquisition of all <br />necessary lands, land rights, and water rights, with exceptions a$ provided by <br />subsections 5(b)(1) and (2) of the Act. <br />(d) Any cost savings credited to the District that are not applied <br />toward reduction of the District's contribution shall be applied toward <br />reduction of the loan obligation, as shall all cost savings credlted to the <br />United States. <br />14 <br />
