�, � r <br />States. <br />COSTS AND RESPONSIBILITIES OF THE DISTRICT <br />7. (a) Funds advanced under thie contract ahall be limired to such costs <br />and expenses as are reasonably incurred in the exercise of sound engineering, <br />construction, and business practices, and may consist of costs for the <br />preparation of designs and specification8, engineers' estimates, legal work, <br />supplies, matefial, equipment rental, labor, payments under construction <br />contracts, actual costs of supervision and administration, not to exceed <br />20 percent of the loan and grant funds provided by the United States, all <br />as approved by the Con[racting Officer and incurred subsequent to March 31, <br />1983. With exceptions as provided by subsections 5(b)(1) and (2) of the Act, <br />such funds shall not be used for the DiStrict's costs or expenses of acquiring <br />any lands or interests therein or any w�ter rights necessary for the successful <br />conatruction, operation, and maintenanc� of the Project, nor sha11 such funds <br />be uaed to reimburae the District for the cost of preparation, processing, or <br />review of the District's Proposal and loan application, or other items included <br />in the District's contribution as provided in Article 5(b). <br />(b) The District now holds oY will acquire and certify without cost <br />to the United States, and will provide for purposes of cons[ructlon and the <br />operation and maintenance of the Pro�ect Works, all water supplies and rights to <br />[he use of water necessary to carry out the Project and to operaCe and maintain <br />the Project Works. Should any dispute arise as to the character, extent, <br />priority or validity of the rights of the District, the District shall <br />promptly bring and diligently prosecute or defend judicial proceedings for the <br />determination of any such dispute and [ake all other measures necessary toward <br />11 <br />
