<br />vlluL /....' <br />L~aL eve e t- <br /> <br />-WATER FACILITIES AGREEMENT <br /> <br />as <br /> <br />THIS AGREEMENT, made in triplicate, hereiT).a,fter referred to <br />H("":-{ " , <br />"AgreementU, is made this 741 day of~, 1980, by and betltleen <br /> <br />the TOWN OF COAL CREEK, COLORADO, being a statutor.y t.ovlfl incOrpOrf.lb;~d <br /> <br />in 1882, hereinafter referred to as HCOAL CRE1;:Ktr; the TOWN OF h'IL- <br /> <br />LIAMSBURG, COLORADO, being a statutory town incorporated in 1888, <br /> <br /> <br />hereinafter referred to as "~1ILLIAMSBURG"; and the CITY OF FLORENCE, <br /> <br />COLORADO, being a statutory city, having been incorporated as a town <br /> <br />in 1887 and declared a second class city on January 20, 1900, by <br /> <br />executive order of the Governor of Colorado, and hereinafter referred <br /> <br />to as "FLORENCE"; each of the Parties being a public body politic, a <br />municipal corporation and a governmental and political subdivision of <br />\ <br />the "State of" Colorado. <br /> <br />A. CONTRACTUAL POWERS;" Pursuant to the provisions of Arti- <br /> <br /> <br />cle XIV, section 18 (2) (a) and (2) (b), of the Colorado Constitution <br /> <br />and the provisions of Part 2, Article 1 of Title 29 of the Colorado <br /> <br />Revised Statutes of 1973, as amended, the Parties hereto are empowered <br /> <br />and authorized to cooperate and contract with one another to provide <br /> <br />water service and to share the costs thereof including but not <br /> <br />limited to the cost of construction, operation, maintenance, repair, <br /> <br />and debt retirement, w~th the approval of the legislative body of <br /> <br />each of the Parties hereto. <br /> <br />B. WATER SERVICE AUTHORITY: Each of the Parties hereto <br /> <br />has and may exercise the powers granted to it pursuant ~o the provi- <br /> <br /> <br />sions of the statutes 'of Colorado, including but not limited to Parts <br /> <br />1, 3, 4 and 7 of Article 35 of Title 31 of the Colorado Revised Sta- <br /> <br />tutes of 1973, as amended, in order to provide water service to the <br /> <br />inhabitants of the service area of the Parties hereto. <br /> <br />C.. DEMAND FOR SERVICE: Each of the Parties hereto is ex- <br /> <br />periencing and will in the future experience continuing demands for <br /> <br />domestic water service beyond the capacity of its present facilities. <br /> <br />D. CONTRACTUAL BENEFITS: Each of the Parties has deter- <br /> <br />mined and by the adoption and ratification of this Agreement does <br /> <br />determine that certain benefits are to be realized by cooperating <br /> <br />\.fith the other Parties hereto in the procurement of additional \.fate:r <br /> <br />'. <br /> <br />\ (\ I <br />'\ \ <br />.. <br />
