The application includes an application for conditional water rights for a structure <br />which is to be augmented and which also is to be used for exchange pursuant to the terms of this <br />Decree. This Court hereby finds, with respect to said right, the following: <br /> <br />A. Name of structure: New Castle Augmentation Station. <br /> <br />B. Legal description of point of diversion: A point on the northerly bank of the <br />Colorado River whence the Southwest corner of Section 31, Township 5 South, <br />Range 90 West of the 6th P.M. bears South 44 030' West a distance of 2,500 feet. <br /> <br />C. Source: Colorado River. <br /> <br />D. <br /> <br />(1) <br /> <br />Date of appropriation: May 22, 1984., <br /> <br />(2) How appropriation was initiated: By formation of the intent to <br />appropriate water for the beneficial uses as claimed herein, by engineering <br />work, and by site inspection at the proposed point of diversion. <br /> <br />E. Amount claimed: 5.0 c.f.s., conditional. <br /> <br />F . Use or proposed use: Municipal, commercial, domestic, irrigation, industrial, for <br />augmentation, replacement, and exchange. <br /> <br />G. Number of acres proposed to be irrigated: Up to 193 acres.. <br /> <br />H. Name and address of owner of land on which points of diversion and places of <br />use are located: The name and address of the owner of the land on which the <br />points of diversion are located is the Town of New Castle, P. O. Box 166, New <br />Castle, Colorado 81647. The place of use is land under water rights diverting <br />from Elk Creek, including land under the Ware and Hinds Ditch. <br /> <br />- 1. This water. right will be used to provide water to the Ware and Hinds Ditch or <br />other water rights located on Elk Creek for augm.entation, replacement, and <br />exchange purposes under the plan for augmentation ~d exchange to be decreed <br />herein.
