Bauer No. 2 Reservoir is also known as Bauer Lake <br />Reservoir. It is the larger of the t~/O reservoirs and lies <br />about 2 miles due South of Bauer No.1. <br /> <br />The Water Company acquired the two reservoirs, two filler <br />ditches and headings, all rights-of-way, and water rights. <br />The water rights are listed in section 5.d. <br /> <br />b. Laws under which organized. The general state laws under <br />which the Bauer Lakes Water Company was organized have been <br />ammended many times since March of 1924, but the Company is <br />s till i n cor p 0 rat e dun d e r , and i n c 0 I!l P 1 i a n c e wit h', a 11 <br />applicable state laws. A certified copy of it's articles of <br />incorporation and by-laws is being sent with, but not a part <br />of, this report. <br /> <br />c. Powers and authorities of organization. The Company <br />enjoys the right to eminent domain as a non-profit water <br />carrier under the appropriate State laws. It's assessing <br />authority is quite specifically spelled out in the Arti~les <br />of Incorporation, together with it's power of disposition of <br />shares taken for non-payment of assessments, in the bylaws. <br /> <br />Article 3.2 specifically vests in the directors the authority <br />and control of "the property, funds and affairs of the <br />company, and the management thereof". <br /> <br />d. Financial status. A financial balance sheet and statement <br />of income and expenditures for calendar years 1982 and 1983 <br />is included in the appendix. <br /> <br />e. Physical assets. The physical assets have already been <br />listed, 1.e., the reservoirs and ditches. The company does <br />not own any major maintenance equipment, but rents local <br />owner-operated equipment when the occasion demands. <br /> <br />4. Chapter lllL Land. <br />a. Land classification. All lands to be irrigated with <br />project water are presently being irrigated, and while not <br />mandetory for this report, a Soils Map is included in the Map <br />Section and the 6 Soils Complex mapping unit descriptions are <br />found in the Appendix. This information was obtained from <br />the Cortez Work Unit of the Soil Conservation Service, more <br />particularly from Dalton Montgomery, the W.U.C., and Allan <br />Price, head of the Soil Survey Section. <br /> <br />The land capability classification is Class 4 for the large <br />majority of the irrigated lands, with a small percentage <br />being classed as 5, due to wetness, shallow soil or some <br />other classification factor. Only areas of 15 acres or <br />larger are shown on the Soils Map as Class 5, but the best <br />estimates for the entire project area are that approximately <br />10% of the irrigated lands are Class 5, with the balance <br />classified as Class 4, and a very tiny percentage as Class 3. <br /> <br />2 <br />
