<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />.1 <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CHAPTER 2 <br />THE DISTRICT <br /> <br />2.1 Organization: <br /> <br />The West Divide Water Conservancy District (District) was created by decree <br /> <br /> <br />of the District Court of Garfield C~unty, Colorado, in 1964, pursuant to the <br /> <br /> <br />Water Conservancy District Act, Title 37, Article 45, CRS 1973, as amended. The <br /> <br /> <br />District is a political subdivision of the State of Colorado and is empowered to <br /> <br /> <br />acquire water, acquire rights-of-way for water works, contract with the United <br /> <br /> <br />States or otherwise to provide for water facilities, assume indebtedness, <br /> <br /> <br />operate and maintain physical works to distribute water supplied, and levy <br /> <br /> <br />charges on services provided. The governing body of the District is Board of <br /> <br /> <br />Directors consisting of 5 members appointed by the Garfield County District <br /> <br /> <br />Court Judge. <br /> <br />The District was formed to provide irrigation and domestic water to the <br /> <br /> <br />lands within the boundaries of the District. More specifically, the District <br /> <br /> <br />was intended to be the contracting entity for construction of the West Divide <br /> <br /> <br />Proj ect by the U. S. Bureau of Reclamation. This Proj ect was authorized for <br /> <br /> <br />construction as part of the Colorado River Basin Project. Since this Project <br /> <br /> <br />has been indefinitely delayed for various reasons, the District is proposing to <br /> <br /> <br />develop small water storage facilities which can be financed through local and <br /> <br /> <br />state sources. Alsbury Reservoir represents the first and most financially <br /> <br /> <br />attractive of these facilities. Construction of small local storage reservoirs <br /> <br /> <br />will in no way negate the need for or reduce the benefits of the original West <br /> <br /> <br />Divide Project. They provide small interim features which can ultimately be <br /> <br /> <br />incorporated into the total Project. <br /> <br />2.2 Financial Status: <br /> <br />Current Financial Statements for the District are presented in Appendix A. <br /> <br />2.3 Physical Assets: <br /> <br />Physical assets of the District are currently limited to office equipment <br /> <br /> <br />required to carry out District business, and to the ownership of conditional <br /> <br /> <br />water rights for this and other projects. <br /> <br />-3- <br />
