He then explained each <br />of the decisions for clarification. <br /> <br />Counsel also explained that, at this point, he is not aware of <br />any decision by Grand Junction yet on appealing to the Supreme <br />Court. They have taken the first step in that process, however, by <br />filing a petition for rehearing with the Court of Appeals. If that <br />peti tion is denied, the City will then have 30 days to decide <br />whether to take the case to the Supreme Court. <br /> <br />INFORMATIONAL ITEMS <br /> <br />BARNETT PETITION FOR INCLUSION <br /> <br />The Assistant Manager reported a Petition for Inclusion has <br />been received by Ute for a 35 acre tract on the West Redlands. <br />There is an l8" main in Broadway which fronts this property. The <br />public notice has appeared once and will appear twice more in The <br />Daily Sentinel. This will be ready for action by the Board at the <br />December meeting. <br /> <br />MEETING WITH GRAND JUNCTION RURAL FIRE PROTECTION DISTRICT <br /> <br />Ronald Jaynes reported that he and the Manager attended an <br />informational meeting with the GJRFPD. The Manager explained that <br />it was a good meeting and there was a spirit of cooperation present. <br />Assurances were given by both entities that each would keep the <br />other informed on what the respective districts are doing within <br />their common boundaries. Anything which would be of interest to the <br />fire district relative to upgrading pipelines, etc. will be <br />forwarded to them. <br /> <br />Mr. Jaynes noted that the Grand Junction Fire Department does <br />not set specifications and criteria outside city limits. Also, the <br />fire district meets only every 3 months and he feels they will rely <br />on the Ute District as an informational resource. <br /> <br />BUREAU OF RECLAMATION APPLICATION FOR M & I WATER RIGHTS <br /> <br />The Manager has received a copy of an application for Vega <br />water storage rights with a 1993 filing date, made by the BuRec. We <br />have indicated to them that we would be interested in buying any <br />water they may develop. They are requesting a letter from the <br />District indicating our interest in any M & I water they may file <br />upon and may become available from Vega. <br /> <br />The Assistant Manager corrected a statement by the Manager. We <br />indicated an interest in the availability of waters, we did not <br />indicate that we would pay nor did we put a value on any water. The <br />BuRec feels that this process might make additional waters available <br />
