-,.

.

.

Page Four Minutes #606

November 10, 1993

sent to the Board with their Agenda (copy filed with original
minutes and made a part of these minutes.) He then explained each
of the decisions for clarification.

Counsel also explained that, at this point, he is not aware of
any decision by Grand Junction yet on appealing to the Supreme
Court. They have taken the first step in that process, however, by
filing a petition for rehearing with the Court of Appeals. If that
peti tion is denied, the City will then have 30 days to decide
whether to take the case to the Supreme Court.

INFORMATIONAL ITEMS

BARNETT PETITION FOR INCLUSION

The Assistant Manager reported a Petition for Inclusion has
been received by Ute for a 35 acre tract on the West Redlands.
There is an l8" main in Broadway which fronts this property. The
public notice has appeared once and will appear twice more in The
Daily Sentinel. This will be ready for action by the Board at the
December meeting.

MEETING WITH GRAND JUNCTION RURAL FIRE PROTECTION DISTRICT

Ronald Jaynes reported that he and the Manager attended an
informational meeting with the GJRFPD. The Manager explained that
it was a good meeting and there was a spirit of cooperation present.
Assurances were given by both entities that each would keep the
other informed on what the respective districts are doing within
their common boundaries. Anything which would be of interest to the
fire district relative to upgrading pipelines, etc. will be
forwarded to them.

Mr. Jaynes noted that the Grand Junction Fire Department does
not set specifications and criteria outside city limits. Also, the
fire district meets only every 3 months and he feels they will rely
on the Ute District as an informational resource.

BUREAU OF RECLAMATION APPLICATION FOR M & I WATER RIGHTS

The Manager has received a copy of an application for Vega
water storage rights with a 1993 filing date, made by the BuRec. We
have indicated to them that we would be interested in buying any
water they may develop. They are requesting a letter from the
District indicating our interest in any M & I water they may file
upon and may become available from Vega.

The Assistant Manager corrected a statement by the Manager. We
indicated an interest in the availability of waters, we did not
indicate that we would pay nor did we put a value on any water. The
BuRec feels that this process might make additional waters available
