I

I

the months of June, July and August. However, a twelve-month operation
of the pump station will be required.

I

B. Surface Water Supply

I

Table 4-a shows the tabulation of monthly recorded stream flows on the
Colorado River.

I

The project involves the construction of two storage reservoirs within the
Metro District Service Area. Beneficial uses will occur as a result of
the construction of these reservoirs. However, the original intent for the
reservoirs was irrigation of the residences in the service area. The prob-
able beneficial uses of the proposed reservoirs will be fire protection and
wildlife habitat. The fire protection will be afforded through available
storage.

I

I

Table 4-b shows the analysis of daily water production, maximum supply rate
and consumption.

C. Water Rights and Utilization

I

Water rights have been acquired and total 25 cfs. The 10 cfs right is the
Gardner Diversion No. 1 and the 15 cfs was originally the Bridges Switch
Pumping Pipeline.

I

On April 1, 1974, in Case No. W-2155, the Water Referee for Water Division
No. 5 awarded to the Gardner Diversion No.1, a conditional water right for
10.0 cubic feet of water per second of time, to be used for municipal, in-
dustrial, residential, commercial, recreation, fire protection, watering
of animals, irrigation of lawns, shrubs and gardens, and the necessary stor-
age, with appropriation date of September 6, 1973. The applicant was di-
rected to file an application for quadrennial finding of reasonable dili-
gence in the development of this conditional water right in April of 1978.
This Ruling of the Referee was confirmed and made a Decree of the Court on
July 23, 1974.

I

I

I

I

On July 31, 1978, the claimant filed, in Water Court for Water Division
No.5, an application for quadrennial finding of reasonable diligence in the
development of the conditional water right.

I

In addition to the conditional water right described above, applicant is the
owner of 15 cfs which was adjudicated conditionally under the name of Bridges
Switch Pumping Pipeline. Application was made in W-3655 to change the said
15 cfs to the same alternate point of diversion which was awarded the con-
ditional water right which is the subject of this application.

I

I

Development has proceeded with respect to plans and specifications and con-
struction of the transmission lines. Therefore, the Water Referee found
that the claimant has shown reasonable diligence in the development of the
proposed appropriation of the 10.0 cubic feet of water per second of time
conditionally awarded to the Gardner Diversion No. 1 and therefore concluded

I

I

I

IV - 2
