The water rights are decreed for East Dillon's uses and for
diversion at the \\'ells. As described previously, the wells are drilled and 7 out of 10 of them are
currently connected to East Dillon' s s~"stcm. The other three \\'elIs are potential back up sources of
water. The existing decrees in W.2 I 7 and W-21 10 have advantageous provisions that could not be
obtained today. including the contemplated right to divert year-round. No new facilities are required
to use these water rights. No Water Court approval is necessal}'. For these reasons these particular
water rights, wells and related assets arc uniquely situated to benefit East Dillon. Purchase of these
interests will give East Dillon o\\11ership and control of its o\vn water supply while freeing the
District from the ever-escalating cost of purchasing water from Vidler.

Allocation of Demand, Depiction, ~'mJ \Vater Rights

The CWCI3 stafT requested clarification of the availability of the various water rights and a
projection of the monthly allocation orthe District demands, depletions. and legal sources of water.
A projection of the monthly demands and depletions at buildout is presented in Table 3 and the total
water right amounts are presented in Table 4. The subject decrees for the various water rights do not
include ternlS or condilions that detine the order that the rights may be used for (he Dislrict's supply.
Further. the monthly use of the water rights will be affected by call conditions on the river system
and actual water use by the District. As a result. the allocation for the water rights. as presented in
Table 5 is an illustration of how the rights may be used. but is not intended to limit or define the
future use of the rights by amount or time of use. In this example. 6.3 acre-feet of Columbus Ditch
consumptive use water is assumed to be furnished to Denver in return for 4.5 acre-feet of storage in
Dillon Reservoir.

-16-

I Bi'''''''fI.Bn,!-~/''III.,.,."rtilll'_,..III''
