A number of limiting conditions were <br />imposed. Year round use. \vith monthly limitations. through the wells was expressly authorized. <br /> <br />East Dillon is purchasing 33 acre feet of water from the Valaer Ditch rights. A copy of the decree <br />in 79CW145 is contained in Appendix D. <br /> <br />Columbus Ditch <br /> <br />The Columbus Ditch originally irrigated lands adjacent to the Blue River in the vicinity of Rock <br />Creck. roughly half-\vay between Dillon Reservoir and Green Mountain Reservoir. In 1969 it "vas <br />changed 10 be diverted for irrigation through the Independent Blue Ditch. located a short distance <br />dO\\llstream. Vidler acquired aone.halfinterest in the Columbus Ditch and changed it to municipal <br />use in Case No. 87C\\'257. That decree. entered October 31. 1990. authorized alternate points of <br />diversion at the Vidler Tunnel collection system and the 10 Vidler wells and storage in Dillon <br />Reservoir. Upon storage in Dillon Reservoir the water could be used as replacement water furnished <br />to Denver in exchange for delivery of storage water pursuant to paragraph 6(b) of the "Summit <br />County Agreement". <br /> <br />East Dillon is purchasing 7 acre feet of water from the Columbus Dilch. A copy of the Decree in <br />Case No. 87C\\'257 is contained in Appendix D. <br /> <br />Dillon Storage Water <br /> <br />Dillon storage water is available pursuant to a County contract with Denver made pursuant to <br />paragraph 6(b) of the Summit County Agreement. In exchange for 7 acre feet of water from <br />acceptable water rights. Denver will store and deliver 5 acre feet for the benefit of parties. including <br />Vidler and the District. allocated rights by Summit County under the Agreement. \\.11ile any of the <br />rights being purchased by East Dillon could be used to meet the 6(b) requirements. East Dillon will <br />most likely dedicate the 7 acre feet of Columbus Ditch water to Denver to obtain its 5 acre feet of <br />Dillon storage water. If the District uses the Dillon Storage water in a new water right tiling. <br />including a plan for augmentation. they \\ill recognize the terms of the 1988 ~10A. as necessary.
