The ditches diverted from Soda Creek. Keystone Creek and the Snake River.
generally between what arc now the Keystone Ski Area and Dillon Reservoir.

The rights \yere changed in Case No. W-217 to municipal use and to alternate points of diversion
at the VidlerTunnel and its collection system. The decree was entered August 24.1974. Limits were
placed on the amount of consumptive use and the season of diversion at the tunnel. and parts of the
original rights were abandoned. The decree recognized Vidler had begun serving \vater for domestic
use via wells in what is now East Dillon. and established methods for determining consumptive use
associated with East Dillon's use. Year-round use of the Rice Ranch rights was provided for in the
decree.

The decree in W-217 did not refer specifically to points of diversion for East Dillon's use. although
there is reference to wells. In Case No. W-211 O. entered March 27. 1975. the Court recognized the
10 Vidler wells as alternate points of diversion for the Rice Ranch rights. Due to the seniority of
these rights and the year-round availability of the rights. they provide a reliable legal water supply
source to support the District's \vater uses.

East Dillon is purchasing sixty-one (61) acre feet of water from the Rice Ranch rights. Copies of
the decrees in W-217 and W-2110 are contained in Appendix D. Also. Appendix I presents a
2/21/2002 letter from the Division 5 Engineer regarding the use of these rights.

/

( "".-oJ

Valaer Ditch

The Valaer Ditch originally diverted from the Blue River below what is now Dillon Dam and
irrigated lands in Sil\'erthorne. Vidler bought 18/25ths of the Valaer Ditch and changed its use to
municipal use in Case No. 79CW145. That decree also authorized alternate points of diversion at

-14-

I U6'hop.H'''gd''''I.t",,,,:ulll', IlIe
