Statements of Opposition: A Statement of <br />Opposition was filed by Red Feather Storage and <br />Irrigation Company on February 24, 1988. No other <br />Statements of Opposition have been filed and the time <br />for filing such statements has now expired. <br /> <br />c. Summarv of Consultation: On March 31, 1988, the <br />Division Engineer for Water Division No. 1 submitted a <br />Summary of Consultation recommending that the <br />Application should be granted. The Referee has given <br />this recommendation due consideration. <br /> <br />d. Resolution of Statements of Opposition: Red <br />Feather Storage and Irrigation Company has approved the <br />terms contained herein. <br /> <br />Requested Water Riqht: The CWCB appropriated the <br />Flow more fully described as follows: <br />KILLPECKER CREEK INSTREAM FLOW - <br />a. Source: The source of the water is Killpecker <br />Creek. <br /> <br />b. Location: For the purposes of this decree, the <br />Killpecker Creek instream flow water right is divided <br />into two segments, both of which can be located on the <br />South Bald Mountain U.S.G.S. quadrangle. <br /> <br />1). Upper Seqrnent: Legal description of the <br />upper stream segment through which an instream <br />flow is claimed: The natural stream channel from <br />the headwaters in SE/4 NE/4 sec. 5 T9N R74W 6th <br />P.M. as the upstream terminus and extending to a <br />point at latitude 40047'49''N, longitude <br />105042'37"W, which point is 500 feet downstream <br />from the confluence with an unnamed tributary. <br />The length of this upper instream flow segment is <br />approximately 1.6 miles. <br /> <br />Administration: For the stream segments in an <br />unsurveyed area, the Division Engineer has <br />determined for administrative purposes that the <br />approximate legal description for the Upper <br />Segment instream flow termini as protracted from <br />U.S.G.S. mapping is as follows: <br /> <br />upstream terminus in the SE/4 NE/4 S5 T9N <br />R74W 6PM, 1850 feet from N line, 700 feet <br />from Eline. <br /> <br />2 <br />
