FINDINGS OF FACT, CONCLUSIONS OF LAW, RULING AND DECREE

IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF THE
COLORADO WATER CONSERVATION BOARD ON BEHALF OF THE
PEOPLE OF THE STATE OF COLORADO,

IN KILLPECKER CREEK, A NATURAL STREAM,

IN THE WATERSHED OF THE CACHE LA POUDRE RIVER

IN LARIMER COUNTY, COLORADO.

This matter comes before the Referee on the Application for
Water Rights of the Colorado Water Conservation Board (CWCB) to
grant its Application for an instream flow water right in
Killpecker Creek ("Instream Flow") .

The Referee has reviewed the Application, has reviewed all
other pleadings in the file, has made such investigations as are
necessary to determine whether the statements in the Application
are true, and as a result is fully advised in the premises, and
does hereby enter the following Ruling:

2. Historv of the proceedinqs:

a. Notice and Jurisdiction: The CWCB filed the above
entitled Application with the Court on December 21,
1987. The case was referred to the Water Referee for
Water Division No. 1 in accordance with the provisions
of C.R.S. ~ 37-92-101, et seq. (1990 Repl. Vol. 15).

Timely and adequate notice of this proceeding has been given
in the manner required by law. The Court has jurisdiction over
the subject matter of this proceeding and over all who have
standing to appear as parties, whether they have appeared or not.
