<br />. <br /> <br />. <br /> <br />at the Judicial Building in Pueblo, Colorado, and that those <br />present were as follows: Steven J. Shupe, Assistant Attorney <br /> <br />General; Dan Merriman, Colorado Division of Wildlife; Steve <br /> <br />Puttmann, Colorado Water Conservation Board; and Kenneth J. <br /> <br />Cooper, Assistant Division Engineer. Charles M. Elliott, Attorney <br /> <br />for Objector, participated by telephone from Denver. <br /> <br />5. That Mr. Merriman and Mr. Puttmann were placed under <br /> <br />oath and testimony was heard. <br />6. That Applicant agreed to submit a proposed ruling in <br /> <br />the matter. which will have been approved by the Objector. <br /> <br />7. That such a proposed ruling has been received by the <br /> <br />Referee which is co-signed by the Attorney for Objector, and <br /> <br />a copy thereof is attached hereto. <br />8. That the Referee filed a ruling on December 20, 1984, <br /> <br />but that a descriptive location as it appeared in the application <br /> <br />and therefore in the said ruling was in error. <br /> <br />9. That by Order of the Court Applicant filed an Amended <br /> <br />Application on January 30, 1985, and on February 11, 1985, the <br /> <br />Water Judge remanded the case to the undersigned Referee. <br />10. That the Applicant is entitled to the ruling which follows. <br />IT IS, THEREFORE, ORDERED AS FOLLOWS: That Applicant be, <br /> <br />and is hereby, awarded an absolute surface water right, to-wit: <br /> <br />NAME AND ADDRESS: The Colorado Water Conservation Board <br />1313 Sherman Street, Room 721 <br />Denver, Colorado 80203 <br /> <br />Page 2, Ruling of Referee 82CW140 <br />
