Pursuant to Order of Referral filed and entered in the

above case on September 24, 1982, the undersigned Water Referee,

having investigated the matter of the Application on file herein,

hereby makes the following findings and ruling thereori:

FINDINGS OF FACT

1. That said Application was filed on September 24, 1982:

and an Amended Application was filed on January 30, 1985.

2. That the Water Clerk caused publication of such filing

as provided by statute; that the time for filing Statements of

Opposition expired on the last day of March 1985, and that none

has been filed.

3. That the Amended Application concerns a claim on

Buttermilk Creek in the Westcliffe area in Custer County, Colorado.
4. That the undersigned Water Referee held an informal

hearing on this and several other related cases on July 19, 1984,
