<br />. <br /> <br />. <br /> <br /> <br />WATER RIGHT <br /> <br />NAME OF STREAM: Buttermilk Creek. <br /> <br />LOCATION OF REACH: Legal description of beginning and end <br />points of minimum stream flow claimed: The natural stream <br />channel from headwaters in vicinity of latitude 38909'56" <br />North longitude 105038'02" West as the upstream terminus <br />and National Forest boundary at latitude 38010'33" North <br />longitude 105036'18" West as the downstream terminus being <br />a distance of approximately 1.9 miles. This segment can be <br />located on the Electric Peak (IS') U.S.G.S. quadrangle, and <br />is located in Custer County, Colorado. <br /> <br />DESCRIPTION OF DITCH AND/OR PIPELINE <br />(MEANS OF DIVERSION): None <br /> <br />SOURCE OF WATER: Buttermilk Creek. <br /> <br />PRIORITY DATE: June 3, 1982, provided, however that this <br />right shall be junior to all priorities awarded in cases <br />filed prior to 1982, and otherwise junior as provided in <br />C.R.S. 37-92-306. <br /> <br />AMOUNT OF WATER: 1.0 c.f.s. <br /> <br />USE OF WATER: To maintain such minimum flows as are required <br />to preserve the natural environment to a reasonable degree <br />pursuant to C.R.S. 37-92-102 and 103. No diversion of the <br />water right herein shall be made from the natural stream <br />channel. <br /> <br />IT IS FURTHER ORDERED That the appropriation herein shall <br /> <br />be subject to the present uses or exchanges of water being made <br /> <br />by other water users pursuant to appropriation or practices in <br /> <br />existence on Buttermilk Creek on June 3, 1982, whether or not <br /> <br />previously confirmed by Court order or decree. <br /> <br />IT IS FURTHER ORDERED That Applicant shall install and <br /> <br />maintain such water measurement devices, recording devices, <br /> <br />content gauges and inlet and outlet measurement and recording <br /> <br />devices, as the case may be, as are deemed essential by the <br /> <br />Office of the State Engineer, and the same shall be installed <br /> <br />and operated in accordance with instruction from said Office. <br /> <br />Page 3, Ruling of Referee 82CW140 <br />
